Consider naming the Security Industry Development Investment Fund

Discussing in groups on October 31 about the Draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization, National Assembly Deputies Group 3 (Thanh Hoa, Tay Ninh) requested the drafting committee to consider naming the Security Industry Development Investment Fund to avoid narrowing the formation source, objectives, beneficiaries, and management mechanism for this fund.

The National Assembly deputies agreed with the need to promulgate a Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization. According to the deputies, this amendment aims to promptly grasp and institutionalize Conclusion No. 158-KL/TW, dated May 26, 2025 of the Politburo on building a security industry in the era of national development and growth and the Party's guidelines and viewpoints on science and technology development, innovation and national digital transformation, and innovation in law-making and enforcement to meet the requirements of national development in the new era.

In addition, it is necessary to synchronously complete the legal system, mechanisms and policies, create an environment for the development of the security industry, and meet the urgent requirements of the practical situation. In particular, it is necessary to form a National Security Industry Complex, establish a Security Industry Development Investment Fund and build specific and appropriate mechanisms and policies, especially regarding financial resources to promote research and development of security industry products and services.

National Assembly Deputy Vu Xuan Hung (Thanh Hoa) expressed his agreement when the draft law separates the Defense Industry Fund and the Security Industry Development Investment Fund. However, to create consistency and unity between the two industries, the drafting committee needs to study and revise some contents in Clause 1, Article 21 to be consistent with the State Budget Law. Because, in the provisions of the State Budget Law and in the socio-economic development programs and plans, there is no provision for a 3-year financial plan but all must be 5 years. Therefore, the draft law should remove the phrase "3-year financial plan" and amend it to "5-year financial plan".

According to delegate Hung, Article 22 of the draft law also needs to be revised to be consistent with decentralization, especially the management of the Defense Industry Fund and the Security Industry Development Investment Fund.

According to the delegate, "Previously, the National Defense and Security Industry Fund was managed and allocated by the Government, but now it is separated and assigned to the Ministry of National Defense and the Ministry of Public Security to directly build, manage and invest because this fund is a financial fund outside the State budget. Therefore, to facilitate the use of these funds, it is necessary to add "investment in works, projects, projects accepting risks, risky investments to develop the national defense industry" in Article 22 to suit the specific development of the national defense industry.

Commenting on this draft law, National Assembly Deputy Cao Thi Xuan (Thanh Hoa) said that due to the special nature of the national defense and security industry, the State needs to have corresponding financial and management policies and mechanisms to remove difficulties and obstacles in the implementation process.

The delegates agreed with the draft Law when it stipulated the National Defense Industry Fund and the Security Industry Development Investment Fund. However, in the draft Law, the Government chose these two funds with two different names: National Defense Industry Fund and Security Industry Development Investment Fund.

The delegate explained: “In essence, these two funds are both non-state budget financial funds and are regulated by the State Budget Law. The State Budget Law clearly stipulates: “a non-state budget financial fund is a fund established by a competent authority, operating independently from the state budget, revenue sources, and expenditure tasks of the fund to perform tasks according to the provisions of law”. However, the draft law stipulates that the Defense Industry Fund is established and managed by the Ministry of National Defense, and the Security Industry Development Investment Fund is established and managed by the Ministry of Public Security”.

The Government's explanation is to ensure the difference between the two funds, avoiding overlap in the implementation process. However, according to delegate Cao Thi Xuan: "If the regulations as in the draft law will not be adequate for the security industry sector because the phrase "development investment" will significantly narrow the source of formation, objectives, beneficiaries, and management mechanism of the security industry fund".

The delegate also expressed the view that the defense industry and security industry are a combination of activities with the goal of ensuring the need for technical equipment and professional means for the people's armed forces. Accordingly, there should be general and unified regulations between the two fields of defense and security, and there should be no difference.

This draft Law is also amended to establish a Security Industry Development Management Council, which is responsible for advising the Minister of Public Security on State management and directing the development of the national security industry; and is assigned the authority to promulgate or submit to State agencies and competent persons to promulgate standards and technical regulations related to security industry products and services.

Regarding this content, delegate Cao Thi Xuan said that, because the current law stipulates that the Prime Minister establishes the State Steering Committee on national defense and security industry, which is an inter-sectoral coordination organization to assist the Government and the Prime Minister in organizing, directing, and operating the construction and development of national defense and security industry and industrial mobilization. The delegate proposed to clarify the relationship between the State Steering Committee on national defense and security industry and the Security Industry Development Management Council, to unify with the general direction and avoid overlap.

During the group discussion, National Assembly member Mai Van Hai (Thanh Hoa) also expressed concerns about the naming of the Security Industry Development Investment Fund. The delegate said that it should be named "Security Industry Fund" because this name would allow regular spending or spending on some urgent and special tasks in the security field. If it were just an investment fund, its goal would only be investment. In reality, this fund also carries out some other urgent and unexpected tasks in addition to budget spending tasks. Accordingly, the delegate suggested that the drafting committee should carefully consider the naming of this fund.

Discussing in Group 3, National Assembly Deputy Le Tan Toi (Tay Ninh) pointed out the fact that currently the trend of criminal activities is growing strongly along with the development of the economy and is globally widespread. In recent times, the police force has made great efforts to crack many major cases, including fraud, drug and human trafficking cases. However, through summarizing these cases, it is seen that the means and tools for investigating all types of crimes, especially transnational crimes, are still very difficult. Meanwhile, in the world today, there are very advanced and modern means of monitoring, managing and suppressing crimes... Therefore, it is necessary to build a more suitable legal corridor, especially creating strong resources for a breakthrough in development in the field of defense and security industry.
