
The Ho Chi Minh City Department of Agriculture and Environment has submitted a document to the Ho Chi Minh City People's Committee proposing the temporary collection of land use right certificate issuance fees in three areas while awaiting a new resolution.
Accordingly, the Ho Chi Minh City Department of Agriculture and Environment proposes that for properties located in the former Ho Chi Minh City area, the fee for issuing land use rights certificates and house ownership certificates (pink book) will be directly collected and deposited into the budget by the Ho Chi Minh City Department of Agriculture and Environment. The Ho Chi Minh City Land Registration Office will instruct wards and communes to transfer fee collection documents electronically to ensure efficiency and prevent loss.
For properties located within the former administrative boundaries of Binh Duong and Ba Ria - Vung Tau provinces, the People's Committees of the wards and communes in these areas will be responsible for collecting and managing the fees. The collected funds will then be aggregated and submitted to the state budget as per regulations, ensuring transparency and accountability.
The above plan will be temporarily in effect until Ho Chi Minh City approves a new resolution on the fee rates and the agency responsible for collecting the fees for issuing land ownership certificates.
According to the Department of Agriculture and Environment, Ho Chi Minh City is currently applying regulations on collecting land use right certificate issuance fees based on each administrative area before reorganization.
Specifically, in the area belonging to Ho Chi Minh City (before the reorganization), the collection of fees was carried out by the Department of Agriculture and Environment of Ho Chi Minh City. Meanwhile, in the areas formerly belonging to Binh Duong and Ba Ria - Vung Tau provinces, the resolutions of the two provinces did not clearly specify the collecting unit, but assigned the Provincial People's Committee to organize the collection, remittance, and management of this money.
Furthermore, according to Resolution 411, the fee for administrative procedures carried out through online public services in Ba Ria - Vung Tau province (before restructuring) was 0 VND for 5 types of fees, including the fee for issuing land ownership certificates.
Based on the above situation, the Ho Chi Minh City Department of Agriculture and Environment believes that in order to ensure uniformity in the collection of land use right certificate issuance fees and to avoid disrupting the processing of applications for citizens, the proposed temporary collection method is necessary.
