Land dispute in Group 10, Dong Anh town (Dong Anh district):

Claiming that the Dong Anh District People's Committee issued a land use right certificate (No. BG 145262, registration number 2288/QD-38) to Mr. Nguyen Quoc Khanh on July 1, 2011, overlapping a portion of the land his family was using, and that there were signs of an error and incorrect address, Mr. Nguyen Van Nham's family, residing in Group 10, Dong Anh town, has repeatedly filed complaints with various levels of government. However, the matter remains unresolved to this day.

According to Mr. Nguyen Van Nham, residing at house number 140, block D7, Dong Anh town, before 1985, he and his wife (Ms. Le Thi Sinh) were employees of Factory Z153 - Armored Corps. During their time working there, he, his wife, and their daughter, Ms. Nguyen Thi Kim Oanh, lived in the factory's staff housing complex.

On October 9, 1985, he was allocated a 70m2 apartment at No. 12, Block D7, Z153 Factory Housing Complex (now Group 10, Dong Anh Town) by the factory, according to Grant Certificate No. 32/HĐNQ. In July 2010, the factory implemented a housing sale project under Government Decree 61/ND-CP for its employees, and his daughter was also eligible to purchase a house under Decree 61/ND-CP.

Since 1985, Ms. Oanh had expanded her property by adding 60 square meters of unused land and used this area continuously until February 2012, when Mr. Nguyen Quoc Khanh (from Dong Anh town) led several people to demolish part of the house on the aforementioned 60 square meters. Outraged by this, Ms. Oanh inquired and learned from Mr. Khanh that the land belonged to him and therefore he had the right to demolish it. Mr. Khanh showed Ms. Oanh his family's land use certificate for the plot. Realizing that Mr. Khanh had never resided on the land she had been using since 1985 but was allowed to purchase the house under Decree 61/ND-CP, Ms. Oanh has repeatedly submitted petitions to the authorities, but the matter remains unresolved.

While the matter remained unresolved, on March 4, 2025, a group of strangers gathered building materials to construct on the disputed plot of land. When Ms. Oanh's family tried to stop them, the group showed them a land use certificate in the name of Ms. Dam Thi Din (Mr. Khanh's mother-in-law). Noticing that the land allocation on Ms. Din's certificate (number 07, block B7, Z153 Factory residential area) did not match the address of plot number 140, block D7, Ms. Oanh continued to file a complaint with the Dong Anh District People's Committee requesting clarification of the land's origin. However, more than a month after submitting the complaint, Ms. Oanh has still not received a response from the authorities.

On April 10, 2025, while present at Group 10, Dong Anh town, the reporter found that the complaints from Mr. Nham and Ms. Oanh's family were accurate. Because the dispute had remained unresolved for over 10 years, the land remained abandoned, detracting from the area's aesthetics. In a conversation with the reporter, Mr. Nguyen Quoc Khanh stated that after being facilitated by the Z153 Factory to purchase a house under Decree 61/ND-CP, on July 1, 2011, he was granted a certificate of land use rights for 61.7m2 of land (certificate number BG145262) ​​at No. 7, Block B7, Z153 Factory residential area, Dong Anh town. Having no need for the land, in 2016 Mr. Khanh completed the procedure to gift the land use rights and assets attached to the land to Ms. Dam Thi Din. On September 14, 2016, Ms. Din was granted a land use right certificate (No. CE 173873) by the Hanoi Department of Natural Resources and Environment for the aforementioned area. Therefore, Mr. Khanh is no longer involved with the disputed land plot. However, Mr. Nham's family claims that the address listed in Ms. Din's land certificate (No. 07, Block B7) does not match the address of the land plot where their family currently lives, which is No. 140, Block D7.

According to Hoang Hai Dang, Vice Chairman of the Dong Anh District People's Committee, upon receiving complaints from residents, on April 12, 2024, the District People's Committee issued Document No. 3181/UBND-VP assigning the Department of Natural Resources and Environment to review and advise the District People's Committee on the matter and resolve it according to regulations.

Following the direction of the District People's Committee, on March 19, 2025, the District Department of Agriculture and Environment, in coordination with the Dong Anh Town People's Committee, held a meeting with Ms. Oanh regarding the issuance of a land use right certificate to Mr. Nguyen Quoc Khanh. According to the meeting minutes, after the Z153 Factory handed over the residential area in groups 10 and 11 to local management, Mr. Khanh's name was included in the handover list (item number 802, apartment 07, block B7, area 61.7m2). However, at the time Mr. Khanh completed the application for the land use right certificate, the Town People's Committee did not create a land title certificate file for the aforementioned plot. Regarding the Dong Anh District People's Committee issuing a land title certificate that does not match the address of the disputed plot, the Head of the Dong Anh District Department of Agriculture and Environment, Hoang Anh Tuan, stated that the department is currently investigating the matter and will officially announce the results and respond to the people when available.

From the above information, it can be seen that the reason for the prolonged dispute over plot number 140, row D7, Dong Anh town, causing a disruption of public order and security in the area, is that at the time of issuing the land ownership certificate to Mr. Khanh, the responsible official did not investigate and verify the actual location of the land. To avoid further conflicts arising from this land dispute and its resulting consequences, we request that the Dong Anh District People's Committee promptly resolve this matter definitively.
