Recently, on behalf of the Politburo , Standing member of the Secretariat Truong Thi Mai signed and issued Regulation No. 114 on controlling power and preventing corruption and negativity in personnel work. This regulation replaces Regulation No. 205 dated September 23, 2019 of the Politburo on controlling power in personnel work and preventing the abuse of power and positions.
To strengthen the prevention and control of the abuse of power in personnel work, according to Regulation 114 - do not arrange family members to simultaneously hold the positions of heads of agencies: Internal Affairs, Inspection, Finance, Banking, Tax, Customs, Industry and Trade, Investment Planning, Natural Resources and Environment, Military, Police, Court, Procuracy. This regulation continues to demonstrate the political determination of the Party, the Central Committee and the Politburo in the work of preventing and combating corruption and negativity; linking control of power with prevention and combating corruption and negativity.
The Politburo prohibits arranging for family members to hold leadership positions in 13 sectors.
Three years ago, the Politburo issued Regulation No. 205 on controlling power in personnel work and preventing abuse of power. During the three years of implementing Regulation 205, 50 cases of family relations holding related positions were discovered to mobilize, assign, and arrange other suitable positions. This time, Regulation 114 is more specific, strengthening the prevention and control of the abuse and misuse of power in personnel work. According to the Regulation, people with family relations must not be assigned to hold related positions at the same time, especially the heads of 13 sectors.
Deputy Head of the Central Organizing Committee Mai Van Chinh said: "According to the Regulations, people with family relationships cannot be assigned to hold related positions at the same time, including: Members of the same standing committee of the Party Committee, Party executive committee, Party delegation, and collective leadership of agencies and units; Heads and deputy heads of the same locality, agency, or unit; Heads of agencies in 13 sectors: Home Affairs, Inspection, Finance, Banking, Tax, Customs, Industry and Trade, Investment Planning, Natural Resources and Environment, Military, Police, Courts and Procuracies at the Central level or at the same level in a locality..."

Compared to Regulation 205 of 2019 of the Politburo, Regulation 114 details the sectors where it is prohibited to arrange people with family relationships. According to the old regulation, people with family relationships cannot hold the same positions as: Secretary, Deputy Secretary, Head of the Organization Committee, Head of the Inspection Committee at the same Party Committee level; Chairman of the People's Committee and head of the internal affairs agency, inspectorate at the same level in a locality; member of the same Party executive committee, Party delegation; head and deputy head of the same locality, agency, unit.
According to Mr. Nguyen Duc Ha, former Head of the Party Base Department, Central Organization Committee, this time the Politburo continues to show its determination and proactiveness in preventing violations: "Regulation 114 stipulates very specifically how to limit the same family being a leader. These are sectors and fields where corruption and negativity are likely to occur. Regulation 114 specifies specific sectors. Second, if you are really talented, then arrange it elsewhere, in another job. It should not be in a small group with only a few people. If it is all family members, in the end, when many people participate in the decision-making process in the family, it will lack objectivity and accuracy."

The 13 sectors specifically mentioned by the Politburo in Regulation 114 are sectors and fields that are prone to negativity, related to budget management, money, projects, and material interests. Along with that, sectors that exercise power, enforce the law, protect the law... are easily exploited to carry out corrupt and other negative acts.
Reiterating the words of General Secretary Nguyen Phu Trong "power must be locked in a cage of mechanisms", Associate Professor, Dr. Vu Van Phuc, Vice Chairman of the Scientific Council of the Central Party Agencies, said that not arranging people with family relationships to simultaneously head agencies in 13 main sectors is a mechanism that has been more clearly and specifically defined to control power: "This is the most painful thing in today's society. Not arranging people from the same family into a small leadership group will overcome the situation that we have long said is "the best descendants" and overcome the situation that we have always said is "the Grandchildren of the Elders". This has been happening for many years now".

It must be seen that controlling power is not only controlling those with positions and power in performing public duties, but also controlling their use of power in personnel work. Regulation 114 avoids appointing relatives to leadership positions in "sensitive" sectors. However, to implement this, within the Party, the responsibility of the Party Committee, especially the leader, must be promoted. The leader must be exemplary, self-aware, and consider carefully to arrange cadres, ensuring that after appointing cadres, public opinion will support them.

Everyone wants their children and family members to grow up and develop. That desire is completely legitimate. It's just that if you are a leader, a leader and manager, you must consider it carefully and set an example. Prohibiting regulations cannot be implemented, but exemplary requirements must be carefully considered and calculated."
Inheriting and promoting family traditions in political activities is a good thing, but to avoid public opinion, we must base on prestige and effectiveness in work as a measure to evaluate capacity. Strictly implementing Regulation No. 114 will contribute significantly to controlling power and preventing corruption and negativity in personnel work, especially in sectors prone to corruption and negativity.
To effectively implement Regulation 114, it is also necessary to regularly inspect and supervise its implementation. When abnormalities are discovered, there is public outrage and it must be strictly inspected and handled according to the Regulation. Only then will Regulation 114 become practical, creating trust among Party members and people in the Party's leadership in personnel work./.
