Subjects of illegal trading, storage and use of drugs

The Provincial People's Court selected the case of "Illegal trading and possession of narcotics" and "Organizing illegal use of narcotics" with three defendants Nguyen Thanh Tuan (born in 1998), Nguyen Van Vui (born in 1999), Nguyen Thi Dung (born in 1995, all residing in Hue City).

According to the case file, between June and December 2022, Tuan repeatedly purchased drugs from two subjects named "Bom" and "Quynh" in Lao Bao, Quang Tri (identity and background unknown) to resell to other people in Hue City.

Since November 2022, Vui knew that Tuan was selling drugs, so he helped Tuan deliver and receive drugs many times to receive money. Dung helped Tuan illegally hide more than 400 grams of Ketamine and more than 2.1 kg of Methamphetamine at his boyfriend's house in Huong Ho ward, Hue city, but did not know about Tuan's drug sales.

On the afternoon of December 16, 2022, at the end of the alley on Bui Thi Xuan Street, Phuong Duc Ward, after Vui went to receive more than 400 grams of MDMA, he was caught red-handed on his way to bring it back to Tuan. A few hours later, at his house on Bui Thi Xuan Street, Phuong Duc Ward, Tuan organized for Dinh Xuan Bach to illegally use drugs.

Nguyen Thanh Tuan also stored a lot of drugs at his house in Phuong Duc ward for sale and use. All the drugs seized at Tuan's residence and Dung's residence were directly purchased and received by Tuan, Vui did not know and did not participate.

Nguyen Thanh Tuan must bear criminal responsibility for the illegal drug trafficking of all the drugs seized at his residence, along with the drugs that Dung hid and the drugs when Vui was caught red-handed, including: 2.2 kg of Methamphetamine, more than 440 grams of MDMA and nearly 580 grams of Ketamine.

Nguyen Van Vui was an accomplice of Tuan in the illegal drug trafficking, was an active practitioner and was responsible for the trafficking of more than 400 grams of MDMA. Nguyen Thi Dung was responsible for the illegal possession of more than 436 grams of Ketamine and more than 2.1 kg of Methamphetamine.

The trial panel sentenced defendant Nguyen Thanh Tuan to 1 year in prison for "Illegal possession of narcotics", 2 years in prison for "Organizing illegal use of narcotics", and death penalty for "Illegal trading of narcotics", the total sentence the defendant must serve is death penalty.

Nguyen Van Vui 20 years in prison for "Illegal drug trafficking"; Nguyen Thi Dung 20 years in prison for "Illegal drug possession".

Immediately after the trial ended, the leaders of the Provincial People's Court chaired a meeting to review the experience to evaluate the strengths and weaknesses of the panel of judges, the court clerk, and the organization of the trial; thereby drawing lessons and making recommendations to improve the quality of the trial.
