Private sector participation in high-speed railway construction: No loosening of legal framework

On the afternoon of July 11, sharing at the press conference announcing the President's Order on 9 Laws recently passed by the 15th National Assembly, 9th session, Mr. Nguyen Danh Huy, Deputy Minister of Construction, said that the Ministry has received a number of proposals from investors interested in participating in the North-South high-speed railway project.

The Deputy Minister of Construction shared: According to current legal regulations, after receiving proposals, the first step is to guide investors to complete the dossier. This completion must fully comply with the provisions of Article 33 of the Investment Law, which clearly states the detailed requirements that investors must meet. At the same time, closely coordinate with the Ministry of Finance to comprehensively assess the benefits of converting the form of investment from public investment to private investment.

The Deputy Minister of Construction added that the Ministry of Construction and the Ministry of Finance are currently working together to develop criteria for evaluating proposal documents. On that basis, the Ministry has sent a document to all interested investors, clearly stating the deadline for submitting documents. After receiving complete documents, the Ministry of Construction will work with the Ministry of Finance to evaluate and synthesize a report for submission to the competent authority for consideration.

Some investors are interested in the North-South high-speed railway project.

Regarding investors' expectations, Mr. Huy emphasized the principle: All businesses and people must comply with current legal regulations. Opening up opportunities for private investment in railways, the Ministry of Construction affirmed that it would not loosen the legal framework. "Whatever the level of incentives, we will implement within the framework of legal regulations. Through the working process, up to this point, no investor has made a proposal that exceeds the legal framework. In case there is a proposal that exceeds the framework, according to regulations, we will have to report to the competent authority for consideration," informed the Deputy Minister of Construction.

Regarding the progress of implementation, Mr. Huy said that the National Assembly has approved the permission to study further forms of private investment for the North-South high-speed railway project. "Currently, the study is still being implemented, and so far no problems have arisen," Mr. Huy emphasized.
