From the case of VTV being copyrighted for the Tao Quan clip: Online copyright infringement is still a problem

Copyright infringement in Vietnam, especially in the digital environment, has been occurring in many forms for many years.

The case of Vietnam Television (VTV) "accusing" the Fanpage of a news site of violating the copyright of the program "Gập nhau cuối năm - Táo quân 2025" produced and copyrighted by VTV, then counter-complaining against VTV's copyright - is attracting public attention.

VTV said this is one of many copyright infringement programs the station has faced in recent times.

According to lawyer Nguyen Thi Thu Ha, Head of the Legal Department - Vietnam Intellectual Property Association, this act violates copyright and related rights. Specifically, it violates the right to copy, the right to create derivative works and the right to communicate the work to the public.

Mr. Do Thanh Hai, Deputy General Director of VTV, said that if social networking platforms were more serious and strict with their policies, and even consciously accompanied content producers, the copyright infringement situation would be resolved.

Copyright infringement in Vietnam, especially in the digital environment, has been occurring in many forms for many years. Up to 80% of copyright infringement is taking place on digital platforms, causing thousands of billions of dong in damage, but there is still no complete solution.

According to the Copyright Office, Ministry of Culture, Sports and Tourism, there are currently many regulations and measures that intellectual property rights holders can apply to protect their intellectual property rights. In addition to applying technological measures to protect and prevent intellectual property infringement, the holders can also request organizations and individuals who infringe intellectual property rights to stop the infringement; remove or delete infringing content on the telecommunications network and internet; apologize, publicly correct and compensate for damages. At the same time, request competent state agencies to handle intellectual property infringement according to regulations, and can even file a lawsuit in court or arbitration to protect their legitimate rights and interests.

In 2023, the Inspectorate of the Ministry of Culture, Sports and Tourism coordinated with relevant agencies to prevent and ensure that subscribers/users of telecommunications services of enterprises across Vietnam could not access 2,763 websites and 3,611 links with infringing content; reviewed and handled organizations and individuals who infringed copyright and related rights. At the same time, thousands of recommendations were sent to enterprises that exploit and use images, sounds, videos , and use computer software programs in production, commercial business activities, and advertising activities to comply with regulations on copyright and related rights.
