Attending the meeting and presenting the draft law, Lieutenant General Thai Dai Ngoc, member of the Party Central Committee, Deputy Chief of the General Staff of the Vietnam People's Army, said that, implementing the provisions of the Law on Promulgation of Legal Documents in 2025, the Government submitted to the National Assembly a draft law amending and supplementing a number of articles of the Law on National Defense; Law on Officers of the Vietnam People's Army; Law on Professional Soldiers, Workers and National Defense Officials; Law on Military Service; Law on Vietnam Border Guard; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Management and Protection of National Defense Works and Military Zones; Law on Militia and Self-Defense Forces; Law on National Defense and Security Education. From a political , legal and practical basis, to ensure the constitutionality and consistency of the legal system, it is extremely necessary to study and amend and supplement 11 laws related to military and national defense.

The amendment and supplementation of these laws aims to promptly and fully institutionalize the policies and orientations in the Party's documents and resolutions, the conclusions of the Politburo and the Secretariat, the provisions of the Constitution, and the Law on Organization of Local Government (amended) related to the arrangement and reorganization of administrative units at all levels. The draft Law is developed in accordance with the provisions of the Law on Promulgation of Legal Documents.

The viewpoint of drafting the law is first of all to institutionalize the Party's guiding viewpoints, the conclusions of the Politburo and the Secretariat on continuing to reorganize the apparatus of the political system on organizing two-level local governments, in which it is necessary to study to specify the regulations related to the authority, functions and tasks in the military and defense fields when not organizing district-level governments, merging commune and provincial levels; reorganizing local military organizations; the merger of ministries and branches will have certain impacts and influences on the coordination and implementation of laws on military and defense.

In addition, inheriting current regulations is still suitable for practice, only amending and supplementing contents related to organization and apparatus after arrangement, ensuring unified effectiveness and efficiency, implementing decentralization and delegation of power in accordance with the reorganization of local troops; thoroughly overcoming overlaps and duplications in functions, tasks, and powers, close to the organization of the Army.

The draft law focuses on amending and supplementing a number of articles on the position, role, authority, functions, and tasks in the military and defense fields related to the organization of two-level local governments to ensure consistency with the provisions of the Constitution, the Law on Organization of Local Government (amended) and relevant legal provisions.

The draft Law consists of 12 articles, including 11 articles amending and supplementing 11 Laws and 1 article on the effective date. In particular, for the Law on National Defense, a number of provisions are amended and supplemented, such as: Determining the construction of regional defense , building commune level as the foundation for local protection; The People's Committee at the provincial level shall issue a curfew in one or several commune-level localities and the People's Committee at the commune level shall issue a curfew in one or several areas under its management.

Amending and supplementing a number of provisions of the Law on Officers of the Vietnam People's Army on the content related to the arrangement of the apparatus of the political system on the organization of 2-level local governments such as: Eliminating a number of positions of Commander, Political Commissar of the Provincial Border Guard Command, Deputy Commander, Deputy Political Commissar of the Provincial Border Guard Command, Commander, Political Commissar of the District Military Command, Deputy Commander, Deputy Political Commissar of the District Military Command to ensure compliance with Project No. 839-DA/QUTW dated April 25, 2025 of the Central Military Commission to continue to arrange the local military organization "lean, compact, strong" to meet the requirements of tasks in the new situation. Supplementing the responsibility of the Chairman of the Provincial People's Committee to decide on calling up reserve officers for training and calling reserve officers into active service, training, and checking mobilization readiness and combat readiness for cadres, civil servants, and reserve non-commissioned officers residing in the locality.

The draft law also amends and supplements a number of provisions of the Law on Professional Soldiers, Workers and National Defense Officials; the Law on Military Service; the Law on Vietnam Border Guard; the Law on People's Air Defense; the Law on Reserve Forces; the Law on Civil Defense; the Law on Management and Protection of National Defense Works and Military Zones; the Law on Militia and Self-Defense Forces; the Law on National Defense and Security Education with related contents on the organization of the political system in terms of organizing two-level local governments. The Government proposes that the National Assembly Standing Committee consider applying a simplified order and procedure for reviewing and approving the draft law.

Presenting the report on the review of the draft law, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi said that the National Assembly's Committee on National Defense, Security and Foreign Affairs agreed with the necessity of promulgating the law with political, legal and practical bases to institutionalize the Party's guiding viewpoint on continuing to reorganize the organization of two-level local governments, ensuring conformity and consistency in the legal system when amending and supplementing the 2013 Constitution and laws related to the organization of the state apparatus. The draft law dossier basically meets the requirements of the Law on Promulgation of Legal Documents 2025; at the same time, it agreed to submit the law to the National Assembly for consideration and approval at the 9th Session (15th National Assembly) according to a shortened process and procedure.

Concluding the discussion, Vice Chairman of the National Assembly Tran Quang Phuong emphasized that the National Assembly Standing Committee agreed with the necessity of promulgating the law and the amendments and supplements to 11 laws. The National Assembly Standing Committee highly appreciated the Government's preparation work and agreed with the review report of the National Assembly's Committee on National Defense, Security and Foreign Affairs.

According to Vice Chairman of the National Assembly Tran Quang Phuong, the draft law dossier is eligible to be reported to the National Assembly for comments and approval at the 9th Session (15th National Assembly) according to the shortened procedures. The content of the draft law is basically consistent with the Party's policies and guidelines, the Constitution, ensuring consistency in the legal system, feasibility, and conformity with the continued arrangement of the 2-level local government apparatus.

The National Assembly Standing Committee proposed to continue reviewing laws in the field of national defense and related laws to propose amendments and supplements to ensure consistency and synchronization. It is proposed to change the name of the law to Law amending and supplementing 11 laws in the field of military and national defense and to continue reviewing, editing and perfecting the draft law.
