VCPMC speaks out when accused of blocking the dissemination of revolutionary songs

The report explaining this has just been sent by VCPMC to state management agencies, and at the same time informed at a press conference on the summary of the center's activities in the first months of 2025 on May 13.

Is there any abuse of monopoly and exploitation of copyright by VCPMC?

Previously, on April 18, BH Media, the company that manages the music products of Tre Film Studio, sent a petition to the authorities to report that VCPMC had obstructed the dissemination of revolutionary music works on digital platforms. According to BH Media's reflection, on the occasion of April 30, a series of famous Vietnamese revolutionary music videos were blocked by VCPMC on the YouTube platform. Specifically, the songs: For the people forget themselves, Unification song, Day and night march by Phan Huynh Dieu and the work Doan Ve Quoc Quan in the album Soldier's song Vol.2 invested and produced by Tre Film Studio.

BH Media said they disagreed with VCPMC's "copyright exploitation" because YouTube had paid royalties for the music videos of Young Film Studio. Specifically, on YouTube's content management system, the information is clearly displayed: VCPMC_CS (ie VCPMC) has attached the rights to the work of the National Guard and received 100% of the "performance rights" (PR - Performance Right) and 100% of the "copy rights" (MR - Mechanical Right). That is, VCPMC will receive royalties paid by YouTube.

The reconciliation statement that VCPMC sent to the musician collecting money from YouTube clearly stated that a song was reconciled for two payments: MR (Mechanical Right) and PR (Performance Right), showing that VCPMC had been paid royalties by YouTube.

"Most of the products of Tre Film Studio were produced decades ago. Currently, these videos no longer have commercial value, only cultural and historical value. Re-releasing on the YouTube platform is an effort by traditional record companies to extend the life of their cultural products. On the other hand, the public also benefits from accessing these cultural products, without having to pay a fee," said a representative of BH Media Company.

"YouTube has closed the copyright for each music video, but VCPMC still wants to collect more copyrights, which will make it difficult for the producers. There are videos that no longer have commercial value, but have cultural and historical value. If VCPMC collects all copyright fees, it will only force the parties to consider removing the videos from YouTube, which will cause the authors to suffer the first loss. In the context of promoting the cultural industry and digital transformation, collecting all copyright fees may make many producers not dare to invest boldly," BH Media argued.

VCPMC affirms "no abuse"

VCPMC said that after receiving feedback from BH Media, the center conducted a data reconciliation. The reconciliation results showed that all musical works used in these recordings are owned by authors/owners who are members of VCPMC, and are under the management and protection of VCPMC. At the same time, the recordings using the above works, posted via the link provided by BH Media, are all cases of using works without the permission of the copyright owner and have not yet fulfilled the obligation to pay royalties. "All of the above-mentioned recordings of works that VCPMC applied technological measures to handle copyright infringement on the YouTube platform have full legal basis and are based on the Petition to handle infringement of the authors, representatives or copyright owners: Pham Tuyen, Doan Nho, Phan Huynh Dieu, Xuan Giao...", VCPMC explained about the decision to block.

Regarding the information that BH Media claimed: "The recordings of the works... were granted exclusive distribution rights to BH Media by Tre Film Studio", VCPMC responded that this (if true) would only resolve the issue of recordings (video/audio) within the scope of transactions between BH Media and Tre Film Studio. According to VCPMC's data, neither of these two units has a contract with VCPMC to request permission or pay for the use of the above works in the form of "physical release" (discs) or "online release" (on the internet).
