Representatives of the Department of Agriculture and Environment and the reservoir management unit inspected the actual situation at Na Cay reservoir project, Na Duong town, Loc Binh district.
Lang Son Irrigation Works Exploitation One Member Co., Ltd. is managing 123 reservoirs, 214 dams, 81 electric pumping stations and more than 1,000 km of various canals. In recent years, violations of the protection scope of irrigation works managed by the company have been quite common. As soon as violations were detected, the company coordinated with relevant parties to draw up records and propose handling of violations. However, handling of violations is still limited. For example, the case of violations of the protection scope of irrigation works in Van Lang district.
On August 27, 2024, after discovering the case of Mrs. VTB's household in Bac Viet commune, Van Lang district arbitrarily dumping woven panels into the Ta Coc pumping station ditch, Bac Viet commune, Van Lang Irrigation Works Exploitation Enterprise coordinated with relevant agencies to draw up a record requesting the household to stop violating the construction and restore the original state within 20 days from the date of drawing up the record. However, on June 6, 2025, we were present at the location of the violation of the protection area of the above-mentioned irrigation works, and the violation had not yet been remedied and the original state restored.
Talking to reporters about the above violation, Ms. Truong Thi Than, a land official of Bac Viet commune, said: Previously, Ms. VTB's family was trading in construction materials in another location. However, due to the impact of the traffic project, they moved closer to the irrigation canal area and poured woven panels for vehicles to transport materials. Immediately after discovering the violation, the relevant units drew up a record, then the commune urged and reminded the family to correct it, but so far the family has not done so.
The violation is clear, the minutes have been made, but the handling of the violation is still not resolute and not thorough, leading to violations of the protection scope of irrigation works still existing.
Along with the case of Ms. VTB's family, in recent years, violations of the protection scope of irrigation works in Van Lang district have been quite common. From 2021 to present, the Van Lang District Irrigation Works Exploitation Enterprise has coordinated with relevant agencies to record 24 cases of violations of the protection scope of irrigation works, of which only 14 cases have been handled so far.
Similar to Van Lang, violations of the protection scope of irrigation works in Loc Binh district are common. Mr. Tran Van Dung, Deputy Director of Loc Binh Irrigation Works Exploitation Enterprise, said: The unit is currently managing 15 reservoirs, 21 dams, 3 electric pumping stations and nearly 200 km of canals. From 2021 to present, the unit has drawn up records and proposed to handle 46 cases of violations of the protection scope of irrigation works. However, the relevant units have only handled 20 cases, while 26 cases have not been handled.
In addition to the two above-mentioned enterprises, in recent years, violations of the protection scope of irrigation works have been common in a number of other areas. Mr. Lieu Van Thong, Deputy General Director of the company, said: From 2021 to now, there have been 234 violations of the protection scope of irrigation works under the management unit in the province, of which 27 cases occurred in the first 5 months of 2025 alone, exceeding the whole year of 2021 (in 2021 there were 26 violations). The main violations include: construction of solid works such as gates, fences, bridges, roads within the protection scope; leveling, expanding or constructing works that affect the function of the works; illegal aquaculture in the reservoir area; direct discharge into irrigation works causing water pollution.
The number of violations is high, but the number of cases that have been completely handled is still low. Specifically, up to now, the relevant units have only completely handled 54/234 cases. According to the company's leaders, the reason for the low number of cases that have been completely handled is because many projects have not been marked for protection or do not have complete legal documents, leading to difficulties in determining the scope and basis for handling; some cases of land donated by people for construction projects cause overlapping of land use rights; some cases of intentional violations to serve production and daily life; some cases still believe that the land around the project is not used, so they have used that land area; coordination between relevant agencies, including local authorities, is not tight, there is still a mentality of respect and fear of conflict... leading to some violations not being handled resolutely from the beginning.
Therefore, in the coming time, the company will continue to coordinate with relevant agencies and units to strengthen the dissemination of contents related to the protection of irrigation works. Along with that, relevant levels, sectors and units will promptly implement the installation of boundary markers to protect irrigation works; review and adjust land use right certificates to separate the land within the protection scope of irrigation works; resolutely handle violations as soon as they are detected, avoiding the situation of "punishing for existence", avoiding the occurrence of more violations; building a model of self-governing communities, protecting irrigation works...
Within the scope of protection of irrigation works, activities must ensure that they do not hinder the operation and safety of the works; there must be management roads and areas for maintenance and handling when incidents occur. Therefore, violations of the scope of protection of irrigation works need to be resolutely and thoroughly handled by relevant units. This will ensure both safety and effectiveness of irrigation works to better serve the production and daily life of the people.
