Regarding the fight against counterfeit goods, the Minister of Industry and Trade proposed applying sanctions that are sufficiently deterrent to violators and promoting propaganda and guidance for businesses to comply with the law.
On the afternoon of June 17, at the socio-economic discussion session, Minister of Industry and Trade Nguyen Hong Dien discussed and answered a number of opinions of National Assembly deputies related to the fight against counterfeit goods and protection of consumer rights, and the reduction of plastic waste in e-commerce transactions...
Accordingly, regarding the issue of market inspection and control, anti-counterfeiting, and consumer rights protection, Mr. Dien expressed his agreement with many delegates' opinions that although ministries, branches, and localities have made great efforts in the fight against counterfeit and poor-quality goods and achieved specific results, the situation is still very complicated.
The reason is that the business of counterfeit and fake goods is profitable, attracting many participants. Along with that, violations are increasingly sophisticated, taking advantage of high technology to commit fraud in the e-commerce environment; the resources of functional agencies are limited; coordination between agencies is sometimes not synchronized, as well as current laws and sanctions are not strong enough to deter. A part, some officials in some sectors and fields are given responsibility but degenerate, change, and assist in violations.
To overcome this situation, Mr. Dien said that in the coming time, the Ministry of Industry and Trade will continue to advise on perfecting legal policies, clearly defining the authority and responsibility of ministries, localities, functional agencies and inter-sectoral coordination mechanisms. Strengthening inspection, supervision, market control, and submitting to the National Assembly for approval the Law on E-commerce to strengthen management of this field.
He also emphasized the need to enhance the responsibility of performing public duties, strengthen mandatory inspection and post-inspection, perfect the mechanism to support local market management forces, and successfully complete assigned tasks. At the same time, he proposed to apply sanctions that are sufficiently deterrent to violators, as well as promote dissemination, propaganda, and guidance for businesses to comply with the law.
Regarding the handling of commercial fraud and counterfeit goods in the electronic digital environment, the Commander of the Industry and Trade sector emphasized that controlling and handling counterfeit goods in the online market is always difficult due to the complexity of the product range, sophisticated technology, limited inspection forces and means, and the need for coordination from many different specialized agencies. Meanwhile, current laws do not have specific regulations on sanctions for new sales and advertising models such as livestream or some other forms and the sanctions are not really strong enough.
To overcome this situation, in the coming time, the Ministry of Industry and Trade will urgently complete the draft Law on E-commerce to submit to the Government and the National Assembly. Accordingly, the Ministry of Industry and Trade proposes to clarify the responsibilities of ministries, localities, and functional agencies with e-commerce models and livestream sales entities.
In addition, it will decentralize and delegate authority to localities in managing e-commerce transactions, while continuing to coordinate with specialized units in inspecting and handling violating items.
“The Ministry will actively and proactively review and handle the use of livestreams and e-commerce websites and applications to trade in counterfeit, fake, and poor-quality goods. Strengthen propaganda and dissemination of instructions to people and businesses to only buy products with clear and guaranteed origins. Coordinate with the National Steering Committee 389 and the Ministry of Public Security to exploit information and prevent counterfeit, fake, and poor-quality goods,” said Minister Nguyen Hong Dien.
Evaluating the performance of e-commerce businesses
In response to the opinions of National Assembly delegates on supporting the building and development of brands, improving competitiveness, and developing the Vietnamese goods market, Mr. Dien added that in the integration process, building and developing brands is important to help improve competitiveness and develop the market for Vietnamese goods.
On the part of ministries, localities and enterprises, they have clearly recognized and actively coordinated to implement many solutions, in which the Ministry of Industry and Trade has implemented at three levels: one is Industry Brand at the national scale; two is Product Brand, Geographical Indication, Collective Trademark, Certification Trademark at the local scale; and three is Product Brand at the enterprise scale.
“In the coming time, the Ministry of Industry and Trade will continue to implement focused brand development programs and raise awareness of the role, significance and necessity of building, developing and managing brands in production, business and investment; consulting on innovation and design improvement to meet the tastes and requirements of domestic and foreign consumer markets, and at the same time build and organize the implementation of propaganda and promotion programs for domestic and foreign images of agricultural products and processed foods,” said the Minister of Industry and Trade.
Regarding the reduction of plastic waste in e-commerce, he said that due to the rapid development of e-commerce (20-25%/year), waste is increasing, affecting the environment. Therefore, he said that policies need to be implemented synchronously, in which the State should develop policies to encourage businesses and people to switch from using traditional products to green products, reducing the amount of plastic waste through promotional programs and specific support policies. Strengthen control and evaluation of the implementation efficiency of e-commerce businesses.
“Currently, in the draft Law on E-commerce, the Ministry of Industry and Trade has incorporated regulations from encouragement to mandatory,” he said, emphasizing the need to increase propaganda and promote socialization in the collection of waste from e-commerce for recycling.
The leader of the Ministry of Industry and Trade also recommended that businesses should pay attention to innovating packaging materials to preserve goods. According to him, the Ministry of Industry and Trade has been and is having an incentive program for businesses to implement this model. For consumers, priority should be given to choosing green consumer products. The Ministry of Industry and Trade has encouraged e-commerce businesses to promote consumers to choose green consumer products through promotional discounts on product sales.
“To contribute to reducing logistics costs, the Ministry of Industry and Trade has coordinated with relevant ministries and branches to submit to the Government the Logistics Services Development Strategy for the 2025-2035 period, with a vision to 2050,” said Mr. Dien./.
