Why hasn't Ms. Nguyen Thi Chut been allocated resettlement land?

(QBĐT) - Regarding the allocation of resettlement land to Ms. Nguyen Thi Chut (born in 1939) in Dong Son village, Cu Nam commune (Bo Trach district), despite repeated directives from competent authorities, the matter remains unresolved. Why?

Details of the case

In 2003, many households in Dong Son village, Cu Nam commune, had to be relocated to make way for the construction of the 500kV power line, circuit 2, passing through the area. Among them was the family of Ms. Nguyen Thi Chut. At that time, affected households were not compensated for their land for site clearance, but only received financial assistance for relocation, compensation for assets on the land, and the allocation of resettlement land at another location. Ms. Chut's household was among those required to relocate and received over 60 million VND in support from the project. However, because the resettlement land plot did not meet the required standards (lacking power lines and being low-lying), Ms. Chut's family did not agree to accept it. Because she was not allocated new land, Ms. Chut returned to live anxiously in her old house, situated between the 500kV power lines, circuit 1 and circuit 2, until today.

Regarding this matter, since 2022, Mr. Pham Van Chien (son and authorized representative of Ms. Chut) has repeatedly submitted petitions to the People's Committee of Cu Nam commune and Bo Trach district, but the issue remains unresolved. The Quang Binh newspaper, in its August 5, 2024 issue, published an article titled "Bo Trach: Promptly allocate new resettlement land for Ms. Nguyen Thi Chut in Cu Nam commune," reflecting the aforementioned situation. At that time, leaders of the People's Committee of the commune and Bo Trach district affirmed that they would allocate land to Ms. Chut to ensure her family's rights. The district People's Committee also set a deadline of the end of July 2024 for the relevant departments and the People's Committee of Cu Nam commune to resolve the matter. However, to this day, the issue remains at a standstill.

The family has not yet agreed to compensate for the price.

Responding to this matter, the Chairman of the People's Committee of Cự Nẫm commune, Nguyễn Văn Lương, stated that, based on the conclusions of the District People's Committee, in July 2024, the commune reviewed the land fund and worked with Mr. Phạm Văn Chiến to select a plot of land to propose to the competent authority for land clearance and preparation of documents for allocating residential land to his family. At the meeting, Mr. Chiến agreed to choose plot number 36, map sheet number 26, in Đông Sơn village (residential land already planned in 2005). After a period of inspection, the family representative refused to accept it, citing unsuitability.

Subsequently, the People's Committee of the commune assigned land administration officials and relevant departments to re-examine all residential land in the area, including the remaining land that had been planned for auction during the 2004-2017 period in the village. Through the inspection and review, plot number 274, map sheet number 26, with an area of ​​591.2 m², was found in Dong Son village. To provide a basis for requesting the competent authorities to resolve the issue and develop a land allocation plan for the family, the People's Committee of the commune provided a detailed plan for the construction of a rural residential area in the area. After Mr. Pham Van Chien agreed to receive the aforementioned plot of land, the People's Committee of the commune hired a consulting unit to conduct a cadastral survey and submit it to the Department of Agriculture and Environment for approval and registration in the 2025 land use plan, as a legal basis for requesting the competent authorities to allocate residential land to Ms. Nguyen Thi Chut in accordance with the law. However, although the land plot's location has been registered in the 2025 land use plan, it has not yet been approved to serve as a basis for land clearance.

Regarding the matter, on March 28, 2025, the People's Committee of Bo Trach District announced the conclusion of the district leaders, assigning the People's Committee of Cu Nam Commune to coordinate with the Department of Agriculture and Environment to urgently work with Mr. Pham Van Chien to agree on a compensation plan for the land exchange between the plots. If Mr. Chien agrees with the plan, the People's Committee of the commune will proceed to prepare a land exchange plan for Ms. Nguyen Thi Chut at plot number 1240. Based on that, the Department of Agriculture and Environment will appraise and advise the People's Committee of the district to approve and complete the procedures for land recovery and exchange for Ms. Nguyen Thi Chut in accordance with regulations. If the household does not agree with the compensation plan, the People's Committee of Cu Nam Commune requests the household to continue waiting for the commune to choose another location.

On March 10, 2025, the People's Committee of Cự Nẫm commune continued working with Mr. Chiến. After discussions and explanations, the family agreed and unanimously requested to be allocated plot number 1240, with an area of ​​294.8m², map sheet number 22, belonging to the detailed planning project for the construction of a rural residential area in Đồng Lớn. This plot of land has already been allocated by the Provincial People's Committee for land use conversion. Currently, the People's Committee of the commune has completed the land clearance work and is requesting the determination of land prices for auctioning the land use rights in 2025.

According to the explanation from the Department of Agriculture and Environment of Bo Trach district, the reason why plot number 274, map sheet number 26, has not been handed over as requested by the family is because compensation and land clearance have not yet been completed, and there is no decision on land use change or land allocation from the Provincial People's Committee, therefore the land allocation procedures cannot be carried out. Meanwhile, plot number 1240, map sheet number 22, has completed land clearance and land allocation by the Provincial People's Committee in 2024. Therefore, the department has requested the District People's Committee to instruct the Cu Nam Commune People's Committee to urgently develop a plan for exchanging plot number 1240, map sheet number 22 and reach an agreement with Ms. Nguyen Thi Chut. However, the local authorities noted the need for a price adjustment plan in case the exchanged plot has a higher or lower land use right value.

Thus, according to the opinion of the Department of Agriculture and Environment of Bo Trach district, if plot number 1240, map sheet number 22, is valued higher than Ms. Chut's old plot, then Ms. Chut must compensate for the difference. Mr. Pham Van Chien expressed his frustration: “According to the local authorities, my mother's old plot (1,434m²) was valued at just over 300 million VND, while plot number 1240, map sheet number 22, is valued at over 900 million VND. This means that to be granted this plot, my mother has to compensate up to 600 million VND, and where will she get the money to do that? Meanwhile, according to previous regulations, when implementing the 500kV power line project, the District People's Committee was responsible for supporting and allocating new residential land free of charge to relocated households.”
