"Desperate"
At the end of July 2024, the People's Committee of Binh Son district (Quang Ngai) together with the district's functional agencies and branches, coordinated with the Binh Chanh commune government to organize the forced demolition of houses built on agricultural land in Dong Binh village.
The house that was forcibly evicted above belongs to Mr. LVM and Ms. D.TKC. In June 2023, Mr. M and his wife built a house on agricultural land with an area of 146.52 m2 .
The People's Committee of Binh Chanh Commune discovered the violation and made a record of it. Afterwards, the People's Committee of Binh Son District fined Mr. M's household 4 million VND for converting agricultural land to non-agricultural land to build a house. At the same time, they forced the restoration of the land to its original condition.
Also in Binh Son district, Ms. VTL's family (Binh Chau commune) built a house on agricultural land and was suspended by local authorities and administratively fined for violations.
Ms. L said that before building the house, she had submitted an application to change the land use purpose but was unsuccessful. Meanwhile, this land area is located in the residential land planning area, eligible for conversion but could not be converted, causing suffering for households lacking residential land like her.
According to Vice Chairman of Binh Son District People's Committee Ung Dinh Hien, there are currently no statistics on how many cases of people building houses on agricultural land.
However, according to reports from communes, there are many households building houses on agricultural land. In the past 2 years, the locality has enforced about 20 cases of building houses on agricultural land and other violations.
It is worth mentioning that although many families are aware that building houses on agricultural land is wrong, they still do it, partly because they cannot convert land use rights, while the need for residential land is becoming increasingly urgent.
Mr. PVN (Nghia Dien commune, Tu Nghia district) has been waiting for the land use purpose to be changed to divide among his children for more than 5 years.
His garden, which covers an area of over 1,000 square meters, has yet to be converted into residential land. The reason is that Quang Ngai province has temporarily stopped allowing land use conversion since 2019.
“The most difficult thing is building a house for my children. I have 3 children and now they are married, so I want to give my daughter a little and my son a little to build a house, because my current house is only 200 square meters, how can that be enough?” Mr. N expressed.
Still have to wait
According to the People's Committee of Quang Ngai province, the suspension of land use conversion for many years is due to waiting for the Government to approve the Provincial Planning for the period 2021-2030, with a vision to 2050. However, the Provincial Planning was approved in November 2023, but up to now, people have not been able to convert land use purposes.
Explaining the above issue, the Department of Natural Resources and Environment (DONRE) of Quang Ngai province said that because it is still waiting for the Government to approve the Provincial Planning Implementation Plan and the 5-year Land Use Plan (2021-2025) before adjusting the land use planning for the period 2021-2030 at the district level.
The Provincial People's Committee has issued a directive document on the preparation, appraisal and approval of the 5-year Land Use Plan 2021-2025 at the provincial level and the preparation and adjustment of the Land Use Plan for the period 2021-2030 at the district level.
Up to now, the People's Committees of districts, towns and cities are urgently completing the dossier to adjust the Land Use Planning to 2030 at the district level according to the Quang Ngai Provincial Planning for the period 2021-2030, with a vision to 2050 and send it to the Department of Natural Resources and Environment for submission to the Appraisal Council. This is the basis for the District People's Committee to submit the resolution to the District People's Council for approval before submitting it to the Provincial People's Committee for approval.
After the Provincial People's Committee approves the adjustment of the District-level Land Use Plan to 2030, the People's Committees of districts, towns and cities shall review the need to change land use purposes to register the targets in the annual district-level land use plan for cases that ensure conditions in accordance with regulations before considering the decision to allow the change of land use purposes.
“In principle, when the Provincial Planning is approved, the District Land Use Planning must be adjusted accordingly, but currently a series of procedures have not been completed. Although the Provincial Planning has been approved, the Plan is not yet available, and the 5-year Land Use Plan has not been approved by the Government. If these steps are completed, the Department of Natural Resources and Environment will immediately appraise the adjustment of the District Land Use Planning within no more than 60 days to serve as a basis for implementation,” said Nguyen Duc Trung, Acting Director of the Department of Natural Resources and Environment of Quang Ngai Province.
