In response to the above issue, on April 22, 2025, traders at Phuong Lam Market submitted a petition to local authorities regarding Phuong Lam Market Joint Stock Company temporarily suspending the provision of goods security services in the market. Requesting support for security and property protection.
Regarding this issue, Ms. Khuat Thi Chien, General Director of Phuong Lam Market Joint Stock Company, said: The reason for this situation is that BOT investors have had many reports about the BOT project being operated in violation of legal regulations from the old investors, business households and local authorities. In particular, on January 20, 2025, the company issued Notice No. 05/TB-CTY on adjusting the collection rates of PDV types at Phuong Lam market project. However, business households did not cooperate with the company on adjusting the prices of these services. Although the adjustment of the collection level of PDV types is suitable to the conditions and actual situation according to the regulations of the People's Council and People's Committee of Hoa Binh province, so that the company can collect revenue to offset expenses is shown in Decision No. 02/2017/QD-UBND, dated January 17, 2017 and Decision No. 31/2019/QD-UBND regulating issues related to service prices for market projects invested with non-budgetary capital.
Accordingly, the company still collects electricity bills at the current price of 4,983 VND/kWh (including electricity price, reactive electricity, VAT and electricity loss; excluding maintenance and repair fees, surcharges for indirect and direct salary payments for staff and employees of the enterprise); clean water bills are collected at 33,000 VND/m3 (collected price includes VAT and loss; excluding maintenance and repair fees, surcharges for indirect and direct salary payments for staff and employees of the enterprise). Although households have paid the rent for the entire project cycle, during the operation and exploitation process, if some construction items are degraded, the users, who are business households, must be responsible for contributing funds for renovation, repair and upgrading; the environmental sanitation fee is expected to be collected at 60,000 VND/household/month (an increase of 30,000 VND compared to the old level). This revenue is used to pay salaries for staff and employees, collect waste, hire transport units, waste and wastewater treatment units, monitor and assess environmental impacts...; overnight goods care fee is 100,000 VND/household/month (an increase of 30,000 VND compared to the old level) to install anti-theft camera systems, security electricity, pay salaries for staff and employees directly and indirectly; fire prevention fee is 50,000 VND/point/month to pay according to the contract for the compulsory fire prevention insurance company and to maintain and repair the entire degraded fire prevention system...
The company has notified these contents to the Provincial People's Committee, departments, branches, functional agencies, the Provincial Police, the People's Committee of Hoa Binh City and the business households operating at the project.
Service fee collection levels are in accordance with regulations
After receiving the notice from Phuong Lam Market Joint Stock Company, the traders submitted a request to the Market Management Board to arrange a meeting to agree on reasonable PDV collections for both parties. Receiving the request from the traders, on March 22, 2025, the company and the traders held a meeting and dialogue to agree on PDV collections. However, the meeting did not reach an agreement between the parties.
On March 29, 2025, the company issued Notice No. 15/TB-CTY on the temporary suspension of services at Phuong Lam market. According to Ms. Khuat Thi Chien, General Director of the company: This is due to the fact that the business households do not cooperate, do not properly perform their rights and obligations according to the content signed in the contract for using business locations with the BOT investor. Because of not ensuring funding to maintain the night security force, waste collection, transportation and treatment, and fire prevention, the company is forced to temporarily suspend the provision of services. After this notice, on April 3, 2025, the business households submitted a request for a dialogue. On April 11, 2025, the company and the business households held a dialogue with the participation of representatives of provincial departments, branches, and local authorities. Although the company and representatives of state management agencies have explained and clarified many issues; provide full information, basis, and regulations with legal value so that the HKDs can understand and understand that the increase in PDV amounts is in accordance with regulations. However, the parties still do not have a common voice, forcing the company to issue Notice No. 20/TB-CTY requesting HKDs to cooperate in exercising their rights and obligations in the project.
Ms. Khuat Thi Chien said: Regarding the increase in prices of PDV, the company has informed households since the end of 2024, and will only start implementing it in February 2025. With the current revenue of this project, the company has sympathized with the business households. On the business side, every month they still have to compensate for losses due to insufficient revenue. The company's increase in PDV is in accordance with the provisions of law and the decision of the Provincial People's Committee. According to Decision No. 02/2017/QD-UBND, dated January 17, 2017 and Decision No. 31/2019/QD-UBND regulating issues related to service prices, the PDV level offered by the company is lower than the regulations.
According to the representative of the Department of Industry and Trade, the functional unit of the Provincial Police and the local government participating in the dialogue on April 11, 2025, all affirmed: The PDV level proposed by Phuong Lam Market Joint Stock Company is implemented in accordance with the decisions issued by the Provincial People's Committee and in accordance with the law. The representative of the leaders of the departments and branches also emphasized: To ensure the management of the company and their rights, the business households should implement the contract of using the business location with the investor after transferring the name and ownership. Because, if the ownership is not implemented, it is a violation of the business households according to the commitment signed in the contract and contrary to Clause 2, Article 2, Phuong Lam Market Regulations issued under Decision No. 186/QD-UBND, dated January 30, 2007 of the Provincial People's Committee. This will lead to the consequence that the investor cannot manage the project.
