As reported by Tuoi Tre Online , the Office of the Ministry of Public Security's Investigation Police Agency said it is investigating a health food production line that used fake test results to bring products to market, produced by Herbitech Technology Company Limited.
The ringleader is Pham Vu Khiem, director of Herbitech Technology Company Limited (located at Block 8, Phu Lo Commune, Soc Son District, Hanoi ). The two counterfeit products identified as health protection foods produced by Herbitech Company are Baby Shark and Medi Kid Calcium K2 for children.
The company producing fake functional foods was "transferred" to Pham Vu Khiem?
According to data from the national business registration system, Herbitech Technology Company Limited, formerly Intechpharm Technology Company Limited, was established in May 2003. Initially, this enterprise had its headquarters in Van Dien town, Thanh Tri district, Hanoi.
Intechpharm Technology is legally represented by Mr. Ha Minh Toan (born in 1968). The initial capital scale is only about 2.2 billion VND.
Mr. Toan contributed 40% to the company, equivalent to 880 million VND, while 4 other people held the remaining 60% of the capital.
In a 2017 business registration update, Intechpharm changed its name to Herbitech Technology Company Limited.
At this time, Pham Vu Khiem (born in 1975) was the director and legal representative of the company. The capital contribution structure was also completely changed compared to the time when Mr. Toan was the owner.
Accordingly, the charter capital also increased to 10 billion VND. The list of new capital contributors includes Pham Vu Khiem with 30%, equivalent to 3 billion VND. Mr. Tran Nghia Vinh contributed more with 55% of the capital, equivalent to 5.5 billion VND, and Mr. Tran Van Thuong contributed the remaining 15%.
However, in December 2017, Mr. Tran Nghia Vinh - the largest shareholder - withdrew his capital, and the structure also changed. Accordingly, Mr. Khiem became the largest shareholder holding 85% of the capital, with the remaining being Mr. Tran Van Thuong.
By March 2018, Mr. Thuong continued to withdraw, Ms. Pham Thi Hien appeared on the list of capital contributors with 15%.
From August 2021 to July 2023, within about 3 years, Herbitech Technology Company Limited continuously increased capital and expanded its scale under Mr. Khiem.
In 2021, the company increased its capital from 10 billion VND to 22 billion VND. By July 2023, the capital had jumped to 40 billion VND.
The capital contribution structure also changed at this time. Mr. Khiem lowered his contribution ratio to more than 70%, Ms. Pham Thi Hien increased it to 17.7% and Ms. Dinh Thi Thu Ha contributed nearly 12%, equivalent to 4.68 billion VND.
Baby Shark and Medi Kid Calcium K2 have online stores
At the police station, Pham Vu Khiem initially confessed to changing the product's declared target. Khiem changed the content to not achieve the target to release it to the market.
Major Nguyen Van Thanh, an officer of the Office of the Ministry of Public Security's Investigation Police Agency, said the suspects would mass-produce products according to customers' criteria.
To allow counterfeit products to be circulated on the market, this group sent samples to authorized companies for testing and re-examination to see if the ingredients and quantities were as announced.
For test samples that do not meet the declared product, the subjects will connect and discuss with testing companies to edit the results, or even falsify the test results.
According to Tuoi Tre Online 's research, products such as Baby Shark and Medi Kid Calcium K2 are sold on many online stores at pharmacies and shops specializing in selling functional foods for mothers and babies.
