In early September 2023, Nguoi Dua Tin's observations at used car dealerships in Ho Chi Minh City showed a deserted and unpopular situation. Business owners said that since August 15, the transfer of ownership for used vehicles has become more complicated.

To transfer the ownership conveniently to the buyer, the old owner must complete the registration and license plate revocation procedure by declaring on the Public Service Portal, then directly submit the vehicle registration and license plate to the vehicle registration agency.

This regulation makes it difficult for many cars that used car dealerships to transfer ownership to customers, because they cannot contact the previous owner, the previous owner is on a business trip, or is far away... All of this leads to a sluggish situation at used car dealerships.

Mr. Trong Giap, owner of a used car salon on National Highway 13, Thu Duc City, shared: “Not only customers buying cars but also business people and salon owners are waiting to hear about the new regulations. Even professional salon sellers find it difficult to find the old owner to transfer the ownership, and people are reluctant to pay money, because if the procedures are complicated or have problems, it will be difficult to install a license plate for use.”

Mr. Trung Tinh - manager of a used car salon in District 7 shared that after the license plate identification day, many old customers contacted the salon to ask them to find the old owner to carry out the license plate retrieval and support the procedure for stamping a new license plate.

"From August 15th until now, the salon has only focused on handling and supporting customers who have not completed the name change procedures. Old customers who need support to return the license plate and press a new license plate are overloaded because now, the procedures are more complicated and the salon has to guide both the seller and the buyer of that car. There are even many cases where customers have to pay fines because the name change is later than the prescribed deadline," said Mr. Tinh.

Mr. Minh Tien, owner of a used motorbike shop in District 1, wondered: "People are short of money so they sell their motorbikes to the shop. The motorbikes kept at the shop cannot be sold immediately. By the time we can sell the motorbike to a new owner, it could be a year later. If the old owner dies, how can we go about the repossession procedure?"

According to Mr. Minh Tien, when selling a car through a store, the old owner usually signs a notarized authorization paper for 3 months, 5 months, sometimes 5 years, 10 years so that the store can represent the old owner to do the paperwork with the new owner.

“The car owner signed a notarized power of attorney for the used car dealership to act on his behalf to complete paperwork with the buyer. But according to Circular 24, the car owner must be the one to complete the recall procedures,” Mr. Tien asked.

Find ways to overcome the shortcomings

Responding to Nguoi Dua Tin's question, Lieutenant Colonel Le Manh Ha - Deputy Head of the Staff Department, Ho Chi Minh City Police said that this agency will set up a team to resolve problems in issuing identification plates.

According to Lieutenant Colonel Le Manh Ha, from August 15 to August 26, Department PC08, Ho Chi Minh City Police received 2,109 records (including 862 first-time vehicle registration records, 56 change-of-class records, 233 name change records and 958 revocation records).

The District Police and Thu Duc City received 776 applications. Of these, 552 were for first-time vehicle registration, 40 were for re-licensing, 60 were for name change, and 124 were for revocation.

Lieutenant Colonel Le Manh Ha said that changing the regulation on registering personal vehicles at the place of permanent residence to registering vehicles at the place of residence has created the most favorable conditions for people.

With the new regulation, the license plate attached to the person, through the vehicle owner's identification code, will ensure the management of registered vehicles, helping to manage closely, reduce human resources, and save time.

However, PC08 Department and District Police, Thu Duc City also encountered some difficulties and problems affecting the resolution results and people's satisfaction.

During the implementation process, the software on the Ministry of Public Security's public service portal sometimes has errors and cannot declare information. In cases where the declaration is successful, the vehicle registration system cannot find the data or has data but cannot print the online vehicle registration declaration.

When querying and looking up customs data, registration, and registration fees, the system reports that it cannot be found. In case it is found, when entering data into the system, there are still some cases of missing information, some cases of locked information, and information cannot be entered...

Therefore, Ho Chi Minh City Police had to collect a list of license plates and send it to PC08 for support, affecting the time it takes to process procedures for people.

There are cases of registration of ownership change with records of revoked registration and license plate before August 15, after issuing the identification plate, correcting and printing the vehicle registration certificate, the software automatically changes the new owner's name to the old owner's name. Or the vehicle registration software does not have the "orange" or "bronze" paint color.

The registration revocation declaration form and license plate number printed online from the vehicle registration system are still not in the correct form as prescribed in Circular 24, and temporary license plates cannot be issued after the revocation procedure has been completed.

In addition, Lieutenant Colonel Le Manh Ha said that according to Circular 24, vehicle owners must retain the license plate and vehicle registration to complete the recall procedure. If they do not complete the recall procedure within 30 days, they will be fined.

However, there are currently many cases where vehicle owners sell vehicles through authorization contracts, so the police have difficulty finding vehicle owners to carry out procedures to revoke license plates, as well as individuals and organizations that pay fines late or in cases of vehicle inheritance or the vehicle owner has died, it is impossible to revoke registration and license plates.

Currently, Ho Chi Minh City Police have assigned PC08 to establish a team to receive and resolve difficulties and problems in the process of decentralizing vehicle registration.

According to Circular 24/2023 of the Ministry of Public Security, from August 15, 5-digit license plates will automatically default to the identification plate of the person whose name is on the vehicle registration system. Therefore, in cases of ownership of a vehicle with a 5-digit license plate that has not been transferred to another owner, the identification plate of the previous owner will automatically default to the identification plate of the previous owner.
