According to the Implementation Results Report of the People's Committee of Quang Ngai province, the operation of the 2-level local government model has initially ensured stability, smoothness, synchronization, efficiency and effectiveness. The province has urgently completed the promulgation of regulations on functions, tasks and organizational structures of specialized agencies at the provincial and communal levels according to the new model, ensuring clarity of people and tasks, avoiding overlapping or omission of functions and tasks.
Notably, the locality has fully implemented the issuance of 100% of internal procedures; configured procedures and forms on the Provincial Administrative Procedure Information System; fully delegated authority to agencies, units, cadres and civil servants. The province also regularly reviews and promptly fixes technical errors of the system to ensure connectivity and synchronization with the National Public Service Portal and related databases.

Regarding personnel, the province has reviewed and arranged a team of officials to perform the tasks of receiving, guiding and handling administrative procedures to ensure the right people, the right jobs, and the right expertise. For the commune level, Quang Ngai urgently improved the work of officials. The province proactively reviewed and transferred staff between communes and wards accordingly, while promoting the provision of necessary conditions such as digital signatures, digital certificates, and personnel to support the digitization of "correct - sufficient - clean - alive" data to effectively operate the Public Administration Service Center...
Soon issue guidelines for establishing commune-level public service units
From the difficulties after more than 3 months of operation, the People's Committee of Quang Ngai province found that: some regulations of ministries and branches on the division of authority of local governments at 2 levels are not consistent with the Law on Organization of Local Government. The capacity to perform the tasks of decentralization and delegation of authority of grassroots governments is not uniform due to lack of human resources; in some places, the staff of civil servants and public employees is limited in qualifications and capacity, which affects the performance of tasks. In the early stages of the arrangement, the regulations on job positions were not clear, so the arrangement of job positions did not ensure expertise and professionalism, affecting the capacity to perform tasks of some civil servants and public employees.
The Provincial People's Committee recommends that the Government assign ministries and branches to continue reviewing and amending regulations on the division of authority of local authorities at two levels so that localities can implement them effectively; and promptly guide or promulgate regulations on job positions so that localities have a basis for implementation.
According to Vice Chairman of the Provincial People's Committee Y Ngoc, the Government has not yet regulated the order, procedures and authority to establish public service units under the People's Committees at the commune level; ministries and branches have not yet provided guidance on the functions, tasks, organizational structure, staffing and public services of public service units at the commune level providing basic and essential public services so that localities have a basis for synchronous and unified implementation.
Therefore, it is recommended that the Government promptly issue a Decree replacing Decree No. 120/2020/ND-CP dated October 7, 2020 regulating the establishment, reorganization, and dissolution of public service units. This includes the procedures and authority to establish public service units under the People's Committees at the commune level. At the same time, direct ministries and branches to promptly provide guidance on the functions, tasks, organizational structure, staffing, and public services of public service units at the commune level providing basic and essential public services so that localities have a basis for synchronous and unified implementation.
The Vice Chairman of the People's Committee of Quang Ngai province said that currently, some commune-level localities have arranged and assigned 2 civil servants to 2 commune-level People's Council Committees according to the plan for arranging and assigning cadres and civil servants of the commune after the arrangement, which has been approved by the district-level Party Committee on the basis of the direction in the official dispatch of the Government's Steering Committee "on temporary orientation for staff arrangement when implementing the arrangement of administrative units and organization of local government at 2 levels". However, some localities are confused about the arrangement, use and evaluation of civil servants of the People's Council Committee. Therefore, the province requested the Ministry of Home Affairs to provide clearer guidance on job positions for civil servants of commune-level People's Council Committees and the use and management of civil servants of commune-level People's Council Committees so that localities have a basis for implementation.
In addition, the Provincial People's Committee recommends that the Ministry of National Defense promptly advise the Government to promulgate: regulations on the order and procedures for appointing and dismissing commanders and assistants of the Commune-level Military Command; regulations on job positions for Commanders, Deputy Commanders, and Assistants; the number of Deputy Commanders and Assistants as prescribed in Clause 5, Article 20 of the 2019 Law on Militia and Self-Defense Forces, amended and supplemented at Point d, Clause 9, Article 10 of the Law amending and supplementing a number of articles of 11 Laws on military and national defense.
