On December 14, the Ministry of Public Security's Security Investigation Agency said it was handling and investigating the case of "Violating regulations on management and use of State assets causing loss and waste; Lack of responsibility causing serious consequences; Giving bribes; Receiving bribes; Taking advantage of positions and powers to influence others for personal gain" occurring at Xuyen Viet Oil Trading, Transport and Tourism Company Limited and a number of related agencies and organizations.
On the same day, the Ministry of Public Security's Security Investigation Agency issued a Decision to prosecute the accused, an Arrest Warrant for temporary detention, and a Search Warrant for the residence of Mr. Le Duc Tho (born in 1970 in Phu Tho), former Secretary of the Ben Tre Provincial Party Committee, to investigate the crime of "Taking advantage of position and power to influence others for personal gain" as prescribed in Article 358 of the Penal Code.
Xuyen Viet Oil Trading, Transport and Tourism Company Limited has its head office at 465-467 Hai Ba Trung, Vo Thi Sau Ward, District 3, Ho Chi Minh City. It is one of nearly 40 major petroleum trading enterprises nationwide, authorized to import and export petroleum.
Xuyen Viet Oil Trading and Tourism Transport Company Limited (Xuyen Viet Oil Company) was granted the first license to export and import petroleum by the Ministry of Industry and Trade on August 22, 2016 and was re-granted this license on November 19, 2021.
At the time of re-issuance of the License to Xuyen Viet Oil Company in 2021, Xuyen Viet Oil Company had 13 retail gasoline stores owned by it and 49 retail gasoline agents in the Company's distribution system.
In 2022, the Ministry of Industry and Trade will inspect compliance with legal regulations in petroleum trading for 33 key traders, including Xuyen Viet Oil Company.
At the end of the inspection, the Ministry of Industry and Trade recorded that at the time of the inspection, Xuyen Viet Oil Company had 10 affiliated retail gasoline stores and 18 retail gasoline agents. Xuyen Viet Oil Company was administratively sanctioned and had its gasoline export and import business license revoked for 1.5 months for violating regulations on not maintaining and meeting the required number of gasoline retail agents.
Specifically, the Ministry of Industry and Trade issued a decision to administratively sanction Xuyen Viet Oil Company with a fine of VND 390 million and revoke its license to export and import gasoline from August 10 to September 13, 2022.
In 2023, the Ministry of Industry and Trade will continue to inspect compliance with legal regulations in petroleum business for Xuyen Viet Oil Company.
At the time of inspection, the Ministry of Industry and Trade recorded that Xuyen Viet Oil Company had 10 retail gasoline stores, however, at the time of inspection, 3 stores had expired Certificates of eligibility to retail gasoline and 20 retail gasoline agency contracts signed with retail gasoline agents that were still in effect.
On the basis of Xuyen Viet Oil Company continuing to fail to maintain and meet the conditions for a petroleum wholesaler, on August 11, 2023, the Ministry of Industry and Trade issued Decision No. 2081/QD-BCT revoking the Petroleum Export and Import Business License of Xuyen Viet Oil Company.
This decision was made based on the inspection results of Xuyen Viet Oil Company and on the consideration of the aggravating circumstances of the company's failure to remedy the violations after the 2022 inspection and repeated violations of the regulations on the Price Stabilization Fund as reported by the Ministry of Finance.
On September 8, 2023, the Ministry of Public Security's Investigation Security Agency (A09) initiated a case of "Violating regulations on management and use of state assets causing loss and waste" occurring at Xuyen Viet Oil Company and a number of related agencies and organizations.
The security investigation agency also issued a decision to prosecute the accused and execute the order to temporarily detain two women: Mai Thi Hong Hanh - Director of Xuyen Viet Oil Trading, Transport and Tourism Company Limited; Nguyen Thi Nhu Phuong - Deputy Director of Xuyen Viet Oil.
Both leaders of Xuyen Viet Oil Company were investigated for "violating regulations on management and use of state assets, causing loss and waste".
Recently, the Ho Chi Minh City Tax Department has announced the public disclosure of information on taxpayers with tax debts for the second period of 2023. According to this list of tax debts, the enterprise with the most is Xuyen Viet Oil Trading, Transport and Tourism Company Limited with an amount of more than 1,500 billion VND.
Currently, hundreds of billions of dong from the Petroleum Price Stabilization Fund of this petroleum enterprise cannot be recovered to the budget.
