Issue 2 Resolutions on model working regulations of the People's Council

On the morning of September 26, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly Standing Committee considered and approved the Resolution promulgating the model working regulations of the People's Councils of provinces and cities; the Resolution promulgating the model working regulations of the People's Councils of communes, wards and special zones.

Improve the quality and efficiency of the People's Council's operations in organizing and implementing the two-level local government model.

The draft Resolution on promulgating the model working regulations of the People's Councils of provinces and cities; the Resolution on promulgating the model working regulations of the People's Councils of communes, wards and special zones presented by Chairman of the Delegation Work Committee Nguyen Thanh Hai said that the development of the Resolution was assigned by the National Assembly to the National Assembly Standing Committee in the Law on Organization of Local Government No. 72/2025/QH15. Thereby, creating a synchronous and unified legal basis in the process of implementing the functions and tasks of the People's Council, the Standing Committee of the People's Council, the People's Council Committees, the People's Council delegations and the People's Council delegates at the provincial and commune levels nationwide to improve the quality and effectiveness of the People's Council's operations in the context of organizing and implementing the 2-level local government model.

Regarding the form of the Resolution, to facilitate localities in looking up documents and ease implementation in the post-merger context, implementing the 2-level local government model, the Committee proposed that the National Assembly Standing Committee consider and develop a Resolution to promulgate 2 Regulations: Model working regulations of the Provincial People's Council and Model working regulations of the Commune People's Council.

The draft updates the basis for promulgating the draft Resolution; removes the provision declaring that Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 of the National Assembly Standing Committee promulgating the Regulations on the operation of People's Councils ceases to be effective from the effective date of this Resolution (in Clause 2, Article 3) because in fact, Resolution No. 753 has not been applied since the National Assembly promulgated the Law on Organization of Local Government in 2015, replacing the Law on Organization of People's Councils and People's Committees in 2003. Remove Clause 3, Article 3: "In the process of implementation, if any problems arise, the Standing Committee of the People's Council of the province or centrally-run city shall propose and recommend the National Assembly Standing Committee to consider amending and supplementing"; add Article 3 (new) regulating the effectiveness of the Resolution; responsibility for implementing the Resolution.

Continue to review, revise, and ensure conformity with the position, role, and nature of each level of People's Council, especially the People's Council at the commune level.

The review report presented by Chairman of the Law and Justice Committee Hoang Thanh Tung stated that the Committee agreed with the necessity of submitting the Resolution to the National Assembly Standing Committee for promulgation. The content of the draft Resolution is consistent with the Party's policies and guidelines on streamlining the political system's apparatus and building a two-level local government model; ensuring constitutionality, legality and no content contrary to relevant international treaties to which the Socialist Republic of Vietnam is a member.

Regarding the issuance of the two Resolutions, the majority of the Committee's opinions agreed with the proposal of the Delegation Work Committee. At the same time, it was recommended to continue reviewing and adjusting the provisions of the draft Regulations to ensure they are consistent with the position, role and nature of each level of the People's Council, especially the People's Council at the commune level.

Some opinions suggested drafting a Resolution of the National Assembly Standing Committee to promulgate model working regulations for provincial and communal People's Councils (Option 2) because they believed that the two draft Resolutions and accompanying regulations overlap in both content and structure. Issuing only one regulation to apply to both provincial and communal People's Councils is also consistent with previous precedents.

Concluding the session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh suggested that the issuance of the two Resolutions should be accompanied by two regulations; at the same time, they should continue to be carefully reviewed because they are in great need at the grassroots level, especially at the commune level with new apparatus and new authority.

At the meeting, 100% of the members of the National Assembly Standing Committee present approved the Resolution promulgating the model working regulations of the People's Councils of provinces and cities; the Resolution promulgating the model working regulations of the People's Councils of communes, wards and special zones.
