This view was expressed by delegate Nguyen Hoang Bao Tran (Ho Chi Minh City) during a discussion at the National Assembly's plenary session on the morning of November 13th, regarding the draft revised Law on Public Employees.
According to the female delegate, this draft clearly demonstrates the spirit of innovation in managing civil servants based on job positions, in a way that is open, transparent, and links authority with responsibility. This is a step forward in line with the policy of streamlining the apparatus and improving the effectiveness and efficiency of public service.
However, based on the practical experience of tens of thousands of civil servants affected by the recent reorganization of the two-tiered local government, Ms. Tran believes that many points still need to be supplemented and adjusted so that the Law truly supports civil servants – those who are directly bearing the responsibilities of the administrative and public service apparatus.

Regarding employment contracts for civil servants, the draft has clarified the types of employment contracts and the rights and obligations of the parties. However, Representative Tran pointed out that in reality, after mergers, many civil servants, despite performing their duties well, find themselves in a state of "mechanical redundancy," not due to incompetence, but because the organization no longer has corresponding positions.
Meanwhile, current regulations lack a mechanism to compel the managing agency to proactively arrange, recommend, or second surplus civil servants to other units within the same public system.
In reality, the delegates stated that the majority of civil servants have to find jobs themselves, contacting relevant agencies to request transfers to suitable positions, and in many cases, their contracts are terminated, which is very disadvantageous.
Therefore, Ms. Tran proposed adding the following regulation: "In cases where civil servants become redundant due to the reorganization of administrative units or the restructuring of public service units, the managing agency is responsible for assigning, seconding, or recommending civil servants to units that match their expertise and capabilities."
The delegates emphasized the proposal that "contracts should not be terminated if the employee still meets the requirements for another job position."
"This is not only humane but also avoids wasting resources, because in addition to their specialized training, civil servants also receive training and development in many other skills from public funds. At the age of 35-50, they are at the peak of their experience and capabilities, and they need to continue contributing instead of becoming unemployed against their will," Ms. Tran stated.
Furthermore, delegates from Ho Chi Minh City suggested that regulations are needed to clearly distinguish between "voluntary resignation" and "resignation arranged by the organization."
Accordingly, she proposed that civil servants who are laid off due to organizational restructuring or the merger of administrative units should receive a one-time severance payment equivalent to at least 12 months' salary, and should also be given priority in being referred to jobs within the public sector or transitional areas.

"This is a necessary policy to ensure social stability, reduce unemployment pressure, especially for middle-aged civil servants who have to worry about their families and children's education. It also demonstrates the spirit of not abandoning civil servants, treating them as partners rather than those left behind," Ms. Tran stated.
Regarding job positions, the female delegate proposed adding a regulation: "When an organization is reorganized or merged, civil servants are allowed to participate in providing feedback on new job positions. If the changed job position is not suitable for their expertise, the agency is responsible for retraining or temporarily assigning them to equivalent work to ensure their livelihood stability."
According to her, this regulation will help employees feel respected and supported by the organization, increasing their commitment and sense of responsibility.
The female delegate from Ho Chi Minh City emphasized that the National Assembly is amending an important law that regulates the professional lives of more than 2.2 million civil servants nationwide. Every regulation, no matter how small, has a profound impact on their lives, thoughts, and beliefs.
Therefore, she hopes that the draft Law on Public Officials (amended) will not only aim for stricter management, but also reflect a humane and supportive spirit, so that each public official, even in changing circumstances, will still be given the opportunity to continue contributing.
