This viewpoint was expressed by delegate Nguyen Hoang Bao Tran (HCMC) when speaking at the discussion session in the National Assembly hall on the morning of November 13, regarding the revised Law on Civil Servants.
According to the female delegate, this draft clearly demonstrates the spirit of innovation in managing the staff according to job positions, in the direction of openness, transparency, and linking rights with responsibilities. This is a step forward in line with the policy of streamlining the apparatus, improving the effectiveness and efficiency of public service activities.
However, based on the experience of tens of thousands of officials who have been affected by the recent reorganization of two-level local governments, Ms. Tran believes that there are still many points that need to be supplemented and adjusted so that the Law can truly accompany officials - those who are directly shouldering the responsibilities of the administrative apparatus.

Regarding the employment contracts for civil servants, the draft has provided more detailed regulations on the types of employment contracts, the rights and obligations of the parties. However, delegate Tran pointed out that in reality, when merging, many civil servants, although completing their tasks well, fell into a state of "mechanical redundancy", not due to weakness, but because the organization no longer had corresponding positions.
Meanwhile, current regulations do not have a mechanism to force competent authorities to proactively arrange, introduce or second surplus civil servants to other units within the same public system.
In fact, delegates said that most civil servants have to find jobs themselves, contact and request suitable job transfers, and in many cases their contracts are terminated, which is very disadvantageous.
Therefore, Ms. Tran proposed to add the regulation: "In case of redundant civil servants due to the rearrangement of administrative units or the reorganization of public service units, the management agency is responsible for arranging, seconding or introducing civil servants to units suitable for their expertise and capacity."
The delegate emphasized the proposal "not to terminate the contract if the employee still meets the requirements of another job position".
“This is not only humane but also avoids wasting resources, because in addition to their specialized training, civil servants are also trained and nurtured in many other skills from public financial resources. At the age of 35-50, they are at the peak of their experience and courage, they need to continue to contribute instead of becoming unemployed unintentionally,” Ms. Tran stated her opinion.
In addition, the delegation of Ho Chi Minh City said that there should be regulations to clearly distinguish between "voluntary resignation" and "resignation arranged by the organization".
Accordingly, she proposed that civil servants who quit their jobs due to organizational reorganization or administrative unit mergers receive a one-time allowance of at least 12 months' salary, and be given priority for job referrals in the public system or transitional areas.

“This is a necessary policy to ensure social stability, reduce unemployment pressure, especially for middle-aged civil servants who have to take care of their families and children's education. It also demonstrates the spirit of not abandoning civil servants, considering them as companion partners and not as people left behind,” Ms. Tran stated her opinion.
Regarding job positions, the female delegate proposed to add the following regulation: “When a unit reorganizes or merges, civil servants are allowed to give opinions on new job positions. If the job position changes and is not suitable for their expertise, the agency is responsible for retraining or temporarily arranging equivalent work to ensure a stable life.”
According to her, this regulation will help officials feel respected and supported by the organization, increasing their commitment and responsibility.
The female delegate from Ho Chi Minh City emphasized that the National Assembly is amending an important law that regulates the professional lives of more than 2.2 million civil servants nationwide. Every regulation, no matter how small, has a profound impact on their lives, thoughts, and beliefs.
Therefore, she hopes that the draft Law on Civil Servants (amended) will not only aim for tighter management, but also demonstrate a humane and companionate spirit, so that each civil servant, despite changing circumstances, will still be given the conditions to continue contributing.
