The Resolution was developed based on the practical experience of investment in construction of national railway and urban railway projects in the recent past, which showed many difficulties and problems, focusing on: resource mobilization; investment procedures; planning implementation; site clearance; human resource training, technology transfer, railway industry development, etc.
The draft retains 11 policies, amends 8 policies and adds 3 new policies. Of these, 8 policies are amended and supplemented, including: mobilizing and arranging capital for national railway investment; adjusting planning; dividing the project into component projects and sub-projects; selecting contractors and investors; overall technical design; establishing total investment, construction estimates, and bid package estimates; compensation, support, and resettlement; and simultaneously implementing some project preparation tasks.
Adding 3 new policies, including: allowing projects to use the FIDIC (International Federation of Construction Contractors) contract model; investing in railway projects with non-state capital to institutionalize Resolution No. 68-NQ/TW on private economic development; policies on exemption and reduction of responsibility for construction participants, promulgating mechanisms and policies.
In particular, the notable point is that for projects with the participation of foreign contractors, the projects are allowed to use the FIDIC contract conditions, apply the consultant's right to instruct and decide according to the FIDIC contract principles, including applying the complaint handling and dispute resolution mechanism.
Regarding the prevention and combat of corruption, waste, and negativity, the draft resolution proposes that, for the selection of investors and contractors for bidding packages using foreign contractors, the Ministry of National Defense, the Ministry of Public Security, the Ministry of Construction, the Ministry of Finance, the Government Inspectorate, and the State Audit shall organize the appraisal of bidding documents, request documents, and contractor selection results when invited by competent authorities; the State Audit shall be responsible for auditing the total investment documents.
