This is a new point in the draft Law on Civil Servants (amended) that is being consulted by the Ministry of Home Affairs before being submitted to the National Assembly at the next session.
According to the Ministry of Home Affairs, the implementation of the 2010 Law on Civil Servants (amended and supplemented in 2019) has revealed a number of limitations that need to be studied and revised to suit the new period. Practice shows that current regulations on civil servant recruitment are not suitable for the requirements of strong innovation, creating connectivity and flexibility in the use of human resources between the public and private sectors, especially attracting and promoting experienced and talented people to participate in the public sector.
In addition, the examination and recruitment mechanism is not yet flexible; the results do not closely reflect the requirements on professional capacity of candidates, and there is no distinction to ensure initiative and dynamism for different types of autonomous public service units, especially for autonomous units of group 1 and autonomous units of group 2.
To overcome the above shortcomings and limitations, in this draft, the Ministry of Home Affairs proposes to innovate the recruitment of civil servants to build a team management mechanism based on clear distinction according to the field of providing essential public services or providing non-essential public services.
