Ministry of Finance guides the handling of headquarters and public land after unit arrangement

(Chinhphu.vn) - To avoid waste and ineffective use of public assets after administrative unit rearrangement, the Ministry of Finance has just issued specific instructions, requiring localities to complete plans to handle surplus assets before June 30, 2025.

The Ministry of Finance clearly guides the handling of headquarters and public land after administrative unit arrangement.

Many localities are slow to implement and confused in handling public assets.

Pursuant to Official Dispatch No. 80/CD-TTg dated June 1, 2025 of the Prime Minister and the request from the Central Internal Affairs Committee , the Ministry of Finance has chaired the organization of inter-sectoral working groups to work with localities to review and guide the handling of public assets after implementing administrative unit rearrangement.

However, according to reports from localities, although some places have developed plans and begun to handle surplus assets, many localities are still slow to implement. Specifically, some provinces and cities have not developed detailed plans, lack determination in organizing implementation, or lack close coordination between local agencies and central agencies located in the area.

The main reasons pointed out by the Ministry of Finance include: lack of guidance from ministries and branches; lack of close direction in some places; lack of coordination between levels and branches. Therefore, the situation of public assets being left vacant and not being effectively exploited is happening in many places.

Notably, the coordination of assets between localities and central agencies is still limited, affecting the process of handing over, receiving and exploiting public assets. In this situation, the Ministry of Finance issued Document 8380/BTC-QLCS dated June 13, 2025 to provide additional specific guidance on the handling and arrangement of public assets.

Complete handover before June 30, completely handle surplus real estate

According to the Ministry of Finance's guidance, district-level administrative agencies must complete the handover of public assets before June 30, 2025. This handover includes headquarters, assets, records, and related documents to avoid disruption of state management and loss of assets.

From July 1, 2025, the newly formed provincial People's Committee after the merger will be fully responsible for the management and use of the transferred assets. In particular, real estate facilities assigned to land fund development organizations or local housing businesses must be reported to the provincial People's Committee for specific exploitation plans, avoiding the situation of leaving them empty and causing waste.

In case the asset disposal plan has been approved but needs to be adjusted due to changes in regulations or implementation, the locality does not need to redo the entire process of preparation, inspection and approval as before. Instead, it only needs to report to the competent authority for decision in accordance with legal regulations.

In addition, the conversion of public property functions, for example converting office buildings to infrastructure assets, will be subject to the provisions of Article 13 of Decree No. 151/2017/ND-CP and related regulations on construction planning and land use.

New points to note

To improve the efficiency of asset handling, the Ministry of Finance recommends that localities coordinate.

Firstly, fully understand the new regulations on standards and norms for the use of public assets and the authority to decentralize the management of public assets issued by the Government and the Prime Minister .

Second, closely coordinate with ministries and central agencies with public assets in the area when developing plans for arrangement and handling, ensuring savings and efficiency. In case of needing to swap headquarters to suit the new management model, it can be temporarily handed over, put into use immediately and complete transfer procedures within 30 days from the date of handover.

Third, fully receive the houses and land transferred by the Ministry and central agencies to preserve and exploit them in accordance with regulations.

Fourth, promptly reflect on problems and propose solutions to the Ministry of Finance or competent authorities for handling, avoiding prolongation and waste.
