This Decision is issued with the List of administrative procedures to be amended, supplemented, replaced, and abolished in the field of housing and real estate business according to the regulations on decentralization, delegation, and determination of authority of local authorities at 02 levels under the management of the Ministry of Construction .
Accordingly, the List of amended and supplemented administrative procedures under the management scope of the Ministry of Construction in the field of real estate business includes: Issuance of real estate brokerage practice certificates; Re-issuance of real estate brokerage practice certificates (in case the certificate is burned, lost, torn, or destroyed due to natural disasters or other force majeure reasons); Re-issuance of real estate brokerage practice certificates (in case the old certificate has expired or is about to expire) - these administrative procedures are performed by the Department of Construction. Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization and delegation of powers in the field of state management of the Ministry of Construction stipulates the amended and supplemented contents.
Regarding the List of alternative administrative procedures within the scope of management functions of the Ministry of Construction in the housing sector, including: Submitting to the Prime Minister for permission to change the function of housing specified in Point c, Clause 1, Article 57 of Decree No. 95/2024/ND-CP; Submitting to the Prime Minister for consideration and decision to change the function and allow the auction of student housing or resettlement housing specified in Point d, Clause 1, Article 57 of Decree No. 95/2024/ND-CP; Changing the function of housing for housing built in projects under the approval authority of the Ministry of Construction. These administrative procedures are replaced by the name of the administrative procedure: Changing the function of housing not belonging to public assets, performed by the Provincial People's Committee. Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating decentralization and delegation in the field of state management of the Ministry of Construction will stipulate the replacement content.
In the field of real estate business, the name of the administrative procedure is replaced: Transfer of all or part of a real estate project decided by the Prime Minister for investment; Transfer of all or part of a real estate project decided by the Provincial People's Committee for investment. Name of the replaced administrative procedure: Permission to transfer all or part of a real estate project, implemented by the Provincial People's Committee. Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization and delegation in the field of state management of the Ministry of Construction will stipulate the replaced content.
For the list of abolished administrative procedures within the scope of management functions of the Ministry of Construction in the housing sector, it is: Notification of the unit qualified to manage and operate apartment buildings in cases where the dossier is submitted to the Ministry of Construction, implemented by the Department of Housing and Real Estate Market Management under the Ministry of Construction. Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization and delegation in the field of state management of the Ministry of Construction stipulates the abolition of this central-level administrative procedure.
Decisions on amendments, supplements, replacements, and abolitions in the fields of housing and real estate business according to regulations on decentralization and delegation of authority under the management scope of the Ministry of Construction take effect from July 1, 2025.
