According to the report on explanation, acceptance and revision of the draft law presented by Chairman of the Committee on Culture and Society Nguyen Dac Vinh, there are opinions suggesting adding regulations prohibiting teachers from giving extra lessons in violation of the law and prohibiting extra lessons for students that teachers are directly teaching.
The Standing Committee of the Culture and Social Affairs Committee affirmed that the draft law does not prohibit extra teaching and learning, but only stipulates that teachers are not allowed to force students to participate in extra learning in any form. This regulation, Mr. Vinh emphasized, aims to limit and overcome the widespread situation of extra teaching and learning.
According to Mr. Nguyen Dac Vinh, the Ministry of Education and Training (MOET) has issued a document regulating extra teaching and learning, in which it is stipulated that teachers are not allowed to give extra lessons to students they are directly teaching.
Commenting on this issue, Ms. Nguyen Thanh Hai, Chairwoman of the National Assembly Delegation Work Committee, emphasized that extra teaching and learning is a legitimate need. The core issue, according to Ms. Hai, is not to profit from it.
Although the Ministry of Education and Training has issued a circular with detailed instructions, according to Ms. Nguyen Thanh Hai, extra teaching and learning still have variations in reality. Accordingly, there are currently 3 popular forms of extra teaching, including: extra teaching at home, extra teaching at the center and extra teaching online.
Ms. Nguyen Thanh Hai raised the issue of teachers teaching online via applications such as Zoom or Google Meets and still collecting extra tuition fees, which is very difficult to manage. In addition, there is the situation of "forcing" parents to voluntarily write applications for their children to take extra classes. Although the draft law stipulates that forcing students to participate in extra classes in any form is prohibited.
From the above reality, Ms. Hai suggested that the draft law should have clearer regulations on extra teaching and learning, to prohibit profiteering from this.

Speaking to clarify this issue, Minister of Education and Training Nguyen Kim Son said the regulation that students cannot be forced to participate in extra classes in any form reflects the ethical viewpoint of teachers rather than being a professional regulation.
Regarding the regulation prohibiting teachers from giving extra lessons to students they are directly teaching in class, Minister Nguyen Kim Son said that in their responsibility to perform their official duties, teachers must complete the task of equipping their students with knowledge during regular class hours.
According to the Minister, if teachers cannot complete their official duties during regular school hours, it means they have not fulfilled their official duties. "If they are allowed to continue teaching the contents of their official duties that must be done at home, it will lead to distortions, causing teachers to not fulfill their official duties," said the leader of the Ministry of Education and Training.
According to the head of the Ministry of Education and Training, for students who are weak in learning and preparing for graduation exams, teachers are allowed to teach their students right in school and this has been clearly regulated. This regulation is with the desire to strictly implement public service responsibilities, teachers must fulfill their responsibilities.
