How are officials assigned to work after they resign or are dismissed?

(Dan Tri) - The Politburo stipulates that after a cadre is dismissed from his or her position, the competent authority will consider and arrange a position one level lower or a suitable position but not more important, based on the actual situation.

The Politburo issued Regulation No. 377 on decentralization of cadre management and planning, appointment, nomination, suspension, dismissal, resignation, and dismissal of cadres.

Procedure for considering removal from office, resignation, dismissal

In which, the Politburo mentioned many important contents related to the dismissal, resignation, and removal of officials and the arrangement of other jobs for officials after resignation, dismissal, and removal.

Regarding the process of considering removal from office, resignation, and dismissal, the Politburo stated that when there is sufficient basis for removal from office, resignation, or dismissal within 10 working days, the Party Committee, the leadership collective, the head of the agency, unit using the cadre, or the agency advising on cadre work are responsible for discussing with the cadre and proposing to the competent authority for consideration and decision.

The competent authority shall consider and decide on the removal from office, resignation, or dismissal within 10 working days. In necessary cases due to objective reasons, the period may be extended but not more than 15 working days.

Plan for job arrangement after resignation or dismissal of officials

Regarding the plan for work arrangement with cadres after being dismissed from their positions, resigning, or being dismissed, the Politburo stipulates that after being dismissed from their positions, competent authorities will consider and arrange them to positions one level lower than their previous positions, or to positions that are more suitable and not more important, based on the actual situation.

After at least 12 months of working in a new position or title, if the officer is assessed to have completed his/her tasks well or better, and at the same time ensures the standards and conditions, the competent authority will consider planning, appointing, and recommending candidates for a position equivalent to the position held when the officer is dismissed from office according to regulations.

If an officer voluntarily resigns (in some cases), the competent authority will consider and arrange a position one level lower than the previous position or a suitable position (in case there are no more positions one level lower than the prescribed position).

After at least 24 months of working in the new position or title, if the violations, shortcomings, limitations, and weaknesses are well overcome, and the candidate is assessed to have completed the task well or better, and meets the standards and conditions, the competent authority will consider planning, appoint, and recommend him/her to run for a position equivalent to the position held when he/she was dismissed according to regulations.

These cases apply to: Cadres who are disciplined with warnings and are assessed by competent authorities to have limited capacity, reduced prestige, and are unable to continue holding assigned positions; cadres who are disciplined with reprimands two or more times during a term or appointment period; cadres who have more than two-thirds of the votes of low confidence at the voting period; cadres who have been classified as not completing their tasks for two consecutive years (related to performing assigned duties and tasks).

For cadres who resign and have less than 5 years of remaining working time, the competent authority will consider and arrange for them to do professional work (not leadership or management work).

If an officer has 5 years or more of work remaining, the competent authority shall consider and arrange a position one level lower than the previous position or a suitable position.

After at least 24 months of working in the new position or title, if the cadre overcomes all violations, shortcomings, and limitations and is assessed to have completed the task well or better, ensuring standards and conditions, the competent authority will consider planning, appointing, and recommending candidates for a position equivalent to the position held when resigning.

For cadres after being dismissed, the competent authority shall consider arranging them to do professional work (not leadership or management work). After at least 36 months of working in the new position, if the cadres have overcome their mistakes, are assessed to have completed their tasks well or better and meet the standards and conditions, the competent authority shall consider planning, appointing and recommending them for candidacy according to regulations.

If after leaving office, resigning, or being dismissed, an official wishes to retire, the Politburo stipulates that he or she will be entitled to benefits and policies according to current regulations.
