The Government has just issued Decree No. 105/2025/ND-CP detailing a number of articles and measures to implement the Law on Fire Prevention, Fire Fighting and Rescue, which specifically stipulates the regime and policies for those mobilized and those participating in fire fighting and rescue.

Regimes and policies for participants in training and professional development in fire prevention, firefighting, rescue and first aid

Decree 105/2025/ND-CP clearly stipulates the regime and policies for people participating in training and fostering professional skills in fire prevention, firefighting, rescue and salvage.

1- Members of the Civil Defense Team, members of the Fire Prevention, Fire Fighting and Rescue Team, members of the specialized Fire Prevention, Fire Fighting and Rescue Team, persons assigned to perform fire prevention, fire fighting and rescue tasks and persons assigned to conduct fire prevention and fire fighting inspections at the facility when participating in training and professional development in fire prevention, fire fighting and rescue are entitled to compensation according to the following regulations:

a) For members of the Civil Defense Team, each day they are compensated an amount equal to 0.6 days of the regional minimum wage;

b) For members of the Fire Prevention, Fire Fighting and Rescue Team at the facility, members of the specialized Fire Prevention, Fire Fighting and Rescue Team, persons assigned to perform fire prevention, fire fighting and rescue tasks and persons assigned to conduct fire prevention and fire fighting inspections at the facility, each day will be compensated an amount equal to 0.3 days of the regional minimum wage;

c) During the training and professional development in fire prevention, firefighting, rescue, and first aid, the employee is entitled to take time off work, receive full salary and other benefits currently paid by the direct management unit; is provided with meals and accommodation, and is paid for round-trip train and bus fares;

d) The agency or organization directly managing the subjects specified in Point a and Point b of this Clause is responsible for paying the compensation.

2- Subjects specified in points a, b, c, e and point g, Clause 1, Article 45 of the Law on Fire Prevention, Fire Fighting and Rescue, when participating in training and professional development in fire prevention, fire fighting and rescue, are entitled to the following benefits:

a) For those who receive salaries from the state budget during the time of participating in training and professional development in fire prevention, firefighting, rescue, and salvage, the agency or organization where they work will pay their full salary, benefits, allowances, business expenses, regimes and policies currently being paid according to current regulations; they will be arranged with accommodation, meals, and paid for round-trip train and bus fares, and will be included in the regular operating expenses of the agency or unit sending the person to participate in the training;

b) For those who do not receive a salary from the state budget during the time of participating in training and professional development in fire prevention, firefighting, rescue, and salvage, they will enjoy the following regime: they will be arranged with a place to eat, a place to stay, and their travel and transportation expenses will be paid directly by the managing unit, and included in the production and business management costs; during the time of participating in training and professional development, they will be paid a salary and other regimes currently paid by the directly managing unit.

3- The regional minimum wage day is determined by the monthly regional minimum wage applicable to employees working in the area prescribed by the Government at the time of training and fostering in fire prevention, firefighting, rescue and first aid divided by 26 days.

Training and support for mobilized people and people participating in fire fighting, rescue and relief

The Decree stipulates that people who are not members of the fire prevention, firefighting and rescue force when mobilized and participating in firefighting, rescue and relief operations are entitled to compensation as follows:

a) If the fire fighting, rescue and relief time is less than 02 hours, the minimum compensation is equal to 0.3 days of the regional minimum wage;

b) If the fire fighting, rescue and relief time is from 02 hours to less than 04 hours, the minimum compensation is equal to 0.45 days of the regional minimum wage;

c) If the fire fighting, rescue, or relief work lasts for 4 hours or more, or for many days, then for every 4 hours, the minimum compensation is equal to 0.6 days of the regional minimum wage. If participating in fire fighting, rescue, or relief work at night from 10:00 p.m. to 6:00 a.m. the following day, it is calculated twice as much as above.

The level with the authority to mobilize shall directly pay compensation to mobilized individuals within its management scope. In case the participants in firefighting, rescue and relief are not mobilized, the People's Committee at the commune level shall pay from the state budget.

Regimes and policies for mobilized people, people participating in fire prevention, fire fighting, rescue and relief who have not participated in health insurance and social insurance and have accidents or injuries

Medical examination and treatment cost support regime

Mobilized people, people participating in fire prevention, fire fighting, rescue, and relief during the time of mobilization, participating in fire prevention, fire fighting, rescue, and relief, if having an accident or being injured, will be supported to pay for medical examination and treatment costs and daily meal allowance during the inpatient treatment period until their health is stable and they are discharged from the hospital at the same level as the support for members of the Security and Order Protection Team as decided by the Provincial People's Council.

Allowance according to the level of loss of working capacity

For mobilized persons, fire prevention, firefighting, rescue and relief workers who have accidents or injuries that reduce their ability to work, they will be paid a one-time allowance or monthly allowance, service allowance according to the level of reduced ability to work according to the conclusion of the Medical Assessment Council. The allowance level is equal to the one-time allowance or monthly allowance, service allowance for workers with reduced ability to work equivalent to the compensation level for workers who have occupational accidents that are not entirely caused by the worker himself/herself according to the provisions of the law on occupational safety and hygiene.

Regimes and policies for mobilized people, fire prevention, firefighting, rescue and relief participants who have not participated in social insurance and die

According to the Decree, if a person who has not participated in social insurance or a person who has received social insurance once and dies due to participating in fire prevention, fighting, rescue, or dies during the first treatment period due to an accident while participating in fire prevention, fighting, rescue, or rescue, the relatives organizing the funeral will be supported to pay for medical examination and treatment costs, death benefits, and funeral expenses as follows:

a) Relatives are entitled to a one-time death benefit equal to the one-time death benefit when dying from a work-related accident according to the provisions of the law on occupational safety and hygiene or a monthly death benefit equal to the monthly death benefit for those participating in social insurance according to the provisions of the law on social insurance. Conditions for receiving a one-time death benefit or a monthly death benefit must ensure the conditions for relatives as prescribed by the law on social insurance for those participating in social insurance;

b) Relatives who organize the funeral will be paid funeral expenses. The amount paid is equal to the funeral allowance for people participating in social insurance according to the provisions of the law on social insurance;

c) In case of death during the first treatment period due to an accident while participating in fire prevention, firefighting, rescue, or relief, relatives will be supported to pay for medical examination and treatment costs according to the provisions in Clause 1 and Clause 3, Article 33 of this Decree.

This Decree comes into force from July 1, 2025.
