Having found evidence of deception in the Nestlé Milo malt milk advertisement, the Dong Nai Department of Health has transferred the case file to the Dong Nai Provincial Police Investigation Agency for verification and clarification.
According to the report, on May 28th, the Department of Health, in coordination with relevant departments and agencies, held a meeting to agree on handling issues related to food safety inspections at Nestlé Vietnam Co., Ltd.
During the meeting, after reviewing the relevant documents and records, representatives from the Department of Health and the inspection team unanimously concluded that the incident showed signs of deceiving consumers and customers. Therefore, the Department of Health recommended transferring the case file to the police investigation agency.
On May 29th, the Department of Health issued a document transferring the case file and handing over all relevant documents to the police investigation agency for verification, clarification, and handling in accordance with the law.
Previously, following a directive from the Food Safety Department regarding coordinated handling of information, the Dong Nai Provincial Department of Health invited relevant units to a meeting to agree on a course of action for handling the product advertising content.
On May 15th, the Department of Health of Dong Nai province directed the Food Safety and Hygiene Division and the Department's Inspectorate to coordinate with the Inspectorate and the Press and Publishing Management Division (under the Department of Culture, Sports and Tourism of Dong Nai province) to work with representatives of Nestlé Vietnam Co., Ltd. in An Binh ward, Bien Hoa city.
During the meeting, the company presented information on two products: “Nestlé Milo 3-in-1 Milk Malt Drink Supplement” (self-declared on December 27, 2021) and “Nestlé Milo Malt Drink Supplement” (self-declared on August 10, 2022). According to the Food Safety Administration's official letter, these two products are not related to the use of the company's information. The National Institute of Nutrition is indicated on the label.
Nestlé Vietnam confirms that it only uses information from the National Institute of Nutrition on the label of the "Nestlé Milo malted milk supplement" product; this information is not used for other products.
In addition, the company also provided a confirmation document from the Institute of Nutrition (dated January 25, 2024) regarding a study evaluating the effectiveness of the product combined with physical education for primary school students. The document consistently states that the product helps improve physical fitness after 3 months of use.
While awaiting further instructions, Nestlé Vietnam has proactively suspended all advertising related to the National Institute of Nutrition on platforms such as television, social media, digital platforms, and billboards.
At the same time, the company has asked its partners to stop posting related content and plans to change the product packaging, with a new version expected to launch in September 2025.
