Is the land with letter "T" on the Certificate residential land?

There are many different ways to understand the letter "T". For example, with the same area of 200 ^m2 , there is a Certificate showing 200 ^m2 of land for the purpose of use "T" (general) without specifying how many ^m2 of residential land, how many ^m2 of other land, or garden land, pond, so there is an opinion that only a part of the area is residential land.

However, there is a paper stating 100 ^{m2 of} land use purpose "T", 100 ^{m2 of} garden; so is the 100 ^m2 of land use purpose "T" above residential land or other land?

Mr. Khuyen recommended that the authorities should have specific written instructions to unify the way to issue and exchange Certificates for people nationwide: "Purpose of use "T" is residential land".

The Ministry of Agriculture and Environment responded to this issue as follows:

On October 28, 1989, the General Department of Land Management issued Circular No. 302 TT/DKTK guiding the implementation of the decision on granting Land Use Right Certificates. Accordingly, the land type with the symbol "T" is identified as "Residential land".

On July 27, 1995, the General Department of Land Administration issued Decision No. 499-QD/DC promulgating regulations on the forms of books for land registration, issuance of Land Use Right Certificates, and establishment of land records. The writing of Certificates during this period was still carried out according to Circular No. 302 TT/DKTK. Accordingly, the purpose of land use on the Certificate was determined according to the Land Administration Book; the land type with "residential purpose" was denoted by the letter "T".

On March 16, 1998, the General Department of Land Administration issued Circular No. 346/1998/TT-TCDC guiding the procedures for land registration, establishment of land records and issuance of Land Use Right Certificates. According to Section I, Part III of Circular No. 346/1998/TT-TCDC, "Purpose of use" recorded on the Certificate: Recorded by conventional symbols for each type of unified land use purpose as prescribed on the last page of the Land Administration Book issued under Decision 499 QD/DC dated July 27, 1995 of the General Department of Land Administration. Land type with "residential purpose" is symbolized by the letter "T".

The determination of residential land area during the implementation period of Decision No. 499-QD/DC and Circular No. 346/1998/TT-TCDC must ensure compliance with the provisions of Article 54 of the 1993 Land Law.

Thus, the expression of land type with symbol "T" during the implementation of Circular No. 302 TT/DKTK is in accordance with the provisions of law; for Certificates issued during the implementation of Decision No. 499-QD/DC before December 1, 2004, the expression of land type with symbol "T" is determined as "for residential purposes" but must ensure the land level that each rural household is allowed to use for residential purposes as specifically prescribed by the Provincial People's Committee on the basis of Article 54 of the 1993 Land Law.
