Proposal to review and amend the 2024 Land Law in line with two-level government

The Ministry of Agriculture and Environment has just sent an official dispatch to the People's Committees of provinces and cities, requesting an assessment of the implementation of the 2024 Land Law and the development of a Law amending and supplementing a number of articles of the Land Law.

Previously, on May 2, the Government Office issued Official Dispatch No. 3801/VPCP-NN conveying the direction of Deputy Prime Minister Tran Hong Ha on amending and supplementing a number of articles of the Land Law and decrees detailing the implementation of the law in accordance with the two-level local government model.

In order to have a basis for proposing amendments and supplements to a number of articles of the Land Law to be submitted to the National Assembly at the 10th Session of the 15th National Assembly, the Ministry of Agriculture and Environment requests that the People's Committees of provinces and cities evaluate the contents of State management of land, including evaluating 3 key contents.

Firstly, the People's Committees of provinces and cities shall assess the situation of promulgation and implementation of legal documents on land according to the authority assigned in the Land Law and detailed implementing documents. In particular, assessment of the decentralization of authority to promulgate documents, compliance with the provisions of higher-level documents, the consistency and synchronization of the legal system, and any problems or difficulties.

Next, the Ministry of Agriculture and Environment requested localities to evaluate the work of propaganda, dissemination and education of land law; the form of organization, subjects, number of training courses, propaganda, dissemination and education of land law, obstacles and difficulties (if any).

Third, the People's Committees of provinces and cities focus on assessing the implementation of regulations on planning, land use plans, land recovery, compensation, support, and resettlement when the State recovers land, allocates land, changes land use purposes, and uses land through agreements on receiving land use rights, land registration, and assets attached to land.

Along with that is the assessment of the issuance of land use right certificates, the information system, land database, land finance, land use regime, administrative procedures in the land sector, inspection, examination, supervision, monitoring, evaluation of land management and use, dispute resolution, complaints, denunciations and handling of violations.

In particular, localities need to focus on clarifying difficulties and obstacles in the process of organizing the implementation of the Land Law and documents detailing its implementation; recommend and propose contents that need to be amended and supplemented to the Land Law to meet the requirements of local authorities at two levels.

Localities propose other solutions to organize the implementation of the Land Law, documents detailing the implementation of the Land Law, as well as remove difficulties and obstacles to continue promoting land resources for development.

On that basis, the People's Committees of provinces and cities shall send reports assessing the implementation of the 2024 Land Law and drafting a Law amending and supplementing a number of articles of the Land Law to the Ministry of Agriculture and Environment before May 20, 2025, for synthesis and reporting to the Government and the Prime Minister.
