The Ministry of Education and Training has responded to the petition of Dak Lak province voters sent to the 7th session of the National Assembly.
Proposing preschool teachers to enter arduous and toxic professions
Accordingly, voters suggested considering adding preschool teachers and primary school teachers to the list of hazardous and arduous occupations, and at the same time having appropriate policies to support people working in this industry and profession to feel secure in their work and stay long-term.
Responding to this content, the Ministry of Education and Training stated that for preschool and primary school teachers, the Labor Code stipulates that employees who ensure the conditions on social insurance payment period according to the provisions of the law on social insurance are entitled to pension.
Workers with reduced working capacity, doing especially heavy, toxic, dangerous work, working in mountainous, remote, border, and island areas on the list prescribed by the Government can retire at a lower age than prescribed.
Preschool teachers, primary school teachers, as well as civil servants and employees must comply with this regulation.
Based on the characteristics of preschool education, the Ministry of Education and Training has proposed that the Ministry of Labor, War Invalids and Social Affairs add to the list of arduous, toxic, dangerous jobs and especially arduous, toxic, dangerous jobs for preschool teachers.
From there, there is a basis to propose reducing the retirement age of preschool teachers compared to the regulations.
The Ministry of Education and Training also said that in the draft Law on Teachers that the ministry is drafting, it has proposed that preschool teachers be allowed to retire 5 years earlier than current regulations.
Suggest to consider, avoid creating "privileges, benefits"
In the latest draft Law on Teachers, the Ministry of Education and Training proposed that teachers in preschools and schools for the disabled can retire at a lower age, but not more than 5 years older than the regulation, and will not have their pension rate deducted due to early retirement.
At the 38th session of the National Assembly Standing Committee, commenting on the content related to teachers being able to retire before the age of 55 without having their pension rate deducted, Vice Chairman of the National Assembly Nguyen Khac Dinh suggested reconsideration.
Because he thinks that if there is such a regulation, the Social Insurance Law will have to be amended and this is not advisable. He thinks that there should be another policy, and such a regulation will be "a privilege, a benefit and a contradiction to the Social Insurance Law that has just been passed".
Chairman of the Law Committee Hoang Thanh Tung also said that the proposal to retire early, retire and not deduct the pension rate as stipulated in the draft law would be different from the provisions of the Labor Code and the Law on Social Insurance.
He said there must be a very convincing explanation and what needs to be done differently, and in case there are different regulations, there must be a proposal for synchronous amendments in the laws, otherwise it will not be implemented.
"If the regulation allows preschool teachers to retire before the age of 5 and keep their pension rate unchanged without deduction, that is a different regulation from the Law on Social Insurance and must be amended synchronously.
How do we research policies? I see that preschool teachers have a very hard time," Mr. Tung said.
Vice Chairwoman of the National Assembly Nguyen Thi Thanh also asked the drafting committee to carefully consider and fully absorb the opinions of the National Assembly Standing Committee to regulate this matter.
Explaining this content later, Minister of Education and Training Nguyen Kim Son said that although this has been regulated differently in the Labor Code, waiting for the Labor Code to be amended will take a long time.
He said this is something that preschool and primary school teachers have been looking forward to and have sent many petitions and letters over the past two years, and it has also been mentioned many times in National Assembly sessions.
He said that there are some points in the bill that are different, but he also hopes that when this law is enacted, it will amend something that is very beneficial for teachers and encourages teachers.
