Proposal to consider streamlining commune-level officials and civil servants who do not meet the standards and conditions of their job positions

The Ministry of Home Affairs proposes that if commune-level cadres and civil servants do not meet the standards and conditions required for their job positions, competent authorities will consider and decide to streamline them according to the provisions of law at the time of streamlining.

The Ministry of Home Affairs is seeking comments on the draft Law on Cadres and Civil Servants (amended). Regarding the transitional provisions, the draft Law clearly states that commune-level cadres and civil servants, as prescribed by the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law on Amending and Supplementing a Number of Articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019) from the effective date of this Law, are on the payroll of the province or centrally-run city; are ranked according to the salary scale and grade corresponding to the assigned job position if they meet the standards and conditions required by the job position.

Carry out recruitment, use and management in accordance with Government regulations on recruitment, use and management of civil servants.

In case of not meeting the standards and conditions required by the job position, the competent authority shall consider and decide on streamlining according to the provisions of law at the time of streamlining.

The Government shall develop a roadmap and issue regulations to gradually transform the management of civil servants according to job positions within 5 years from the effective date of this Law.

During the 5-year period, the management of staff, recruitment, management and use of civil servants will continue to be implemented according to Government regulations.
