- New Year Bonus 2024
According to information on Health & Life, currently, the law does not have specific regulations on Tet bonuses. Tet bonuses for employees are currently applied according to the regulations on bonuses in Article 104 of the 2019 Labor Code.
Accordingly, bonus is the amount of money that the employer rewards the employee based on the annual production and business results and the employee's level of work completion. The bonus regulations are decided by the employer and publicly announced at the workplace after consulting the representative organization of the labor collective at the facility.
Thus, paying Tet bonuses is not a mandatory regulation but only an incentive provision of the employer. The amount of bonus will be based on the agreement between the employer and the employee through the labor contract and collective labor agreement.
The form of Tet bonus for employees depends on the corporate culture as well as the actual conditions of each enterprise, including bonuses in cash or in kind. Many enterprises give Tet bonuses in the form of products that the enterprise itself produces.
In case the business makes a loss or when the employee does not complete the work according to regulations, they may not receive the Tet bonus.
- Salary for New Year's Day 2024
According to Article 112 of the 2019 Labor Code, on the occasion of New Year 2024, employees will be entitled to take a day off and receive full pay.
However, due to work requirements, employees at many agencies and businesses still work on New Year's Day 2024. This will be considered overtime.
According to Article 107 of the 2019 Labor Code, employees are only required to work on New Year's Day if they agree. When agreeing to work, employees will be paid overtime according to the provisions of Article 98 of the 2019 Labor Code as follows:
- Working during New Year's Day: 300% additional salary for normal working days.
- Working at night on New Year's Day: Additional 390% of normal working day salary.
If an employee does not take a day off on New Year's Day but still goes to work, it is considered overtime. Illustrative photo.
-New Year Holiday 2024
According to the Department of Labor Safety ( Ministry of Labor, Invalids and Social Affairs ), the 2024 New Year holiday will be implemented in accordance with the provisions of the 2019 Labor Code.
In 2024, New Year's Day falls on Monday (January 1, 2024), workers will have 1 day off and receive full pay.
However, December 30 and 31, 2023 fall on Saturday and Sunday. Therefore, during the 2024 New Year holiday, officials, civil servants, public employees and workers at state agencies will have a 3-day holiday.
According to Dan Tri, for workers with 2 days off per week (Saturday, Sunday), on New Year's Day they will have 3 consecutive days off, including 2 weekly days off and 1 holiday (Monday).
If working at a unit with a 1-day weekly off (Sunday), employees will have a 2-day New Year's holiday in 2024 (from December 31, 2023 to January 1, 2024).
After more than a month off for the New Year, workers will have a 7-day Lunar New Year holiday, from December 29, Quy Mao, to January 5, Giap Thin (February 8-14, 2024). Civil servants and workers will have two days off before Tet, three days after Tet, plus two days off in lieu of falling on the weekend.
National Day holiday is four days off, from August 31 to September 3, 2024, from Saturday to the following Tuesday. Civil servants and workers do not have to take compensatory leave, so it is convenient to arrange work, travel , and return to their hometowns; parents and students have more time to prepare before the annual school opening day.
The remaining holidays of 2024 will be implemented according to the provisions of the Labor Code, but will be shorter because they fall in the middle of the week.
Specifically, Hung King's Commemoration Day (10th day of the 3rd lunar month) will be one day off, Thursday, April 18, 2024.
Reunification Day and International Labor Day are 2 days off, April 30 - May 1, 2024, from Tuesday to Wednesday.
The above holiday schedule applies to civil servants and public employees, but the Ministry of Labor, Invalids and Social Affairs encourages businesses to let their employees take holidays according to the general schedule. For the Lunar New Year, businesses must notify employees 30 days in advance.
