On June 11, 2024, Cong Thuong Newspaper published an article: "Clothing products at Ech Com Baby Products lack conformity certificates". The content of the article reflects that Ech Com store located at 287 Tran Dang Ninh, Cau Giay district is selling many clothing products such as pants, shirts, blankets, hats, etc. for babies from 1 to 6 years old without a conformity certificate (CR) as prescribed by law.

Immediately after the newspaper was published, the editorial office received many readers' reports about the above violations at some stores of the Ech Com Baby Products system in Hanoi . From the information reported by readers, the reporter continued to investigate the reality of some stores of the Ech Com Baby Products system at the addresses 148 Tran Duy Hung, Cau Giay district; 322 Ho Tung Mau, Nam Tu Liem district; 59 Nguyen Hoang, Nam Tu Liem.

At the above stores, reporters recorded a common situation: many garment products such as pants, shirts, blankets, hats, etc. for babies do not have a certificate of conformity (CR), and information about origin is unclear.

In addition, some products imported from foreign countries have incomplete information on Vietnamese labels and stamps, lacking much information about the origin of the product, causing difficulties for consumers.

Circular No. 07/2018/TT-BCT on amending Circular No. 21/2017/TT-BCT issued by the Ministry of Industry and Trade , from January 1, 2019, textile and garment products before being put on the market must be certified in accordance with QCVN 01:2017/BCT on the limit of formaldehyde content and aromatic amines converted from Azo dyes in textile products.

According to this Regulation, from January 1, 2019, the list of textile products subject to the regulation includes: Pants, shirts, skirts, garment fabrics, carpets, garment accessories such as socks, towels, hats, gloves, ties, blankets, sheets, pillows, mattresses, curtains, shoes, sports sandals , tennis shoes, basketball shoes, gym shoes, training shoes and similar types... can only be circulated on the market after being certified as conforming, having a conformity mark affixed and registering a conformity certification dossier according to regulations.

In Clause 4, Article 3, Decree 43/2017/ND-CP dated April 14, 2017 also clearly stipulates that a supplementary label is a label showing mandatory content translated from the original label of the goods in a foreign language into Vietnamese and supplementing mandatory content in Vietnamese according to the provisions of Vietnamese law that the original label of the goods is missing.

To manage the State in this field, Decree 43/2017/ND-CP, amended and supplemented by Decree 111/2021/ND-CP, dated December 9, 2021, stipulates product labels, effective from February 15, 2022. Accordingly, regulations on product labels for textile, garment, leather and footwear products must include the following information: Ingredients or quantitative ingredients; Technical specifications; Warning information; Instructions for use, instructions for preservation; Year of manufacture.

According to information from the General Department of Market Management (Ministry of Industry and Trade), if an organization or individual commits a violation of product labeling, according to the new regulations in Decree No. 126/2021/ND-CP, they will be fined from VND 500,000 to VND 120,000,000 for goods worth from VND 5 million to over VND 100 million; in some specific cases of violation, goods with labels violating national sovereignty, political security, and customs will be confiscated, and the right to use licenses and practice certificates will be revoked; in addition, remedial measures will be applied such as: forced to remove from the territory of the Socialist Republic of Vietnam or forced to re-export imported goods; forced to recall goods and force to label goods properly before continuing to circulate; forced to recall and destroy labels of violating goods, etc.

Thus, it can be seen that the sales at some stores of the Ech Com Baby Products system are showing signs of not being implemented in accordance with current legal regulations. This not only causes difficulties for consumers in choosing products but also poses a potential risk to consumers' health if the formaldehyde content in textile products exceeds the permitted standard.

We request that the authorities inspect and clarify the above issue at the Ech Com Baby Products store system and strictly handle violations (if any) to ensure the rights of consumers.
