Dialogue, review and settlement of citizens' complaints

On the morning of October 29, at the Provincial Citizen Reception Office, the Working Group to inspect, review, and resolve complaints and denunciations of large numbers of people, complicated and prolonged according to the plan of the Government Inspectorate, organized a dialogue with citizen Tran Van Suu, residing at Group 31, Phan Dinh Phung Ward (formerly Group 5, Tuc Duyen Ward) and citizen Nguyen Nhu Chung (son of Mr. Nguyen Nhu Ky), residing at Thai An Sub-area, Phu Luong Commune.

Mr. Tran Van Suu was previously granted Land Use Right Certificate No. B873412 by the People's Committee of Thai Nguyen City. In 2004, Mr. Suu completed the procedures to transfer the land use rights for this plot to his three children.

In 2005, Mr. Suu submitted a request to the People's Committee of Tuc Duyen Ward to correct the land classification recorded on the Land Use Right Certificate for plot 88b, with an area of ​​200m2 (5% land), to residential land to match the land classification on the map.

During the dialogue, the Task Force reported on the results of the process of resolving citizens' requests.

Accordingly, Mr. Tran Van Suu's complaint was resolved (first time) by the People's Committee of Thai Nguyen City in 2006; and resolved (second time) by the Chairman of the Provincial People's Committee in 2007, stating clearly that Mr. Suu's complaint was unfounded; the resolution process was carried out in accordance with the law.

The working group also discussed and clarified Mr. Tran Van Suu's request for a land use right certificate (residential land, based on the current use of 275m2).

The working group unanimously reported and advised the Provincial People's Committee to issue a notice terminating the handling of Mr. Tran Van Suu's complaint; and reported to the Provincial People's Committee to assign the Phan Dinh Phung Ward People's Committee to inspect the entire current land use status of Mr. Suu's family, and consider granting a land use right certificate in accordance with the Land Law.

During the dialogue, the Task Force also reviewed the case of citizen Nguyen Nhu Chung (son of Mr. Nguyen Nhu Ky), residing in Thai An sub-district, Phu Luong commune.

According to the complaint, in 1966, the family cleared a 7,000m2 plot of land in the Dong Kho mountain area, Du town, Phu Luong district, for cultivation. In 1993, the family registered to participate in Project 327 to plant tea and fruit trees. On September 21, 2003, the Phu Luong District People's Committee allowed Song Lo Enterprise (the contractor for National Highway 3) to level the land the family was using.

Mr. Nguyen Nhu Ky's family argues that land leveling should be done with a land reclamation decision and compensation should be provided according to regulations. Therefore, Mr. Ky's family has submitted petitions and complaints to the Phu Luong District People's Committee and other state agencies.

Mr. Nguyen Nhu Ky's complaint was resolved (first time) in 2006 by the Chairman of the Phu Luong District People's Committee and (second time) in 2008 by the Chairman of the Provincial People's Committee, following the correct procedures and regulations of the law, ensuring the legitimate rights and interests of citizens.

Mr. Nguyen Nhu Ky's family has received the full amount of compensation and support for land-based production, totaling over 53.7 million VND. The resolution also clearly stated that the request for compensation for 7,000m2 of land under the loan agreement signed with Phu Luong State Farm for Project 327, which required a land reclamation decision and compensation according to regulations, had no basis for resolution.

During the dialogue, relevant departments and agencies exchanged views and clarified the request. Based on the family's opinions and the results of the meeting, the Task Force unanimously agreed to continue the review and requested Mr. Nguyen Nhu Ky's family to cooperate in providing additional relevant documents and records to facilitate the verification process as required.
