The working group also discussed and clarified Mr. Tran Van Suu's request to be granted a land use right certificate (residential land type according to current usage status is 275m2).

The working group unanimously reported and advised the Provincial People's Committee to issue a Notice of termination of handling the complaint of Mr. Tran Van Suu; reported to the Provincial People's Committee to assign the People's Committee of Phan Dinh Phung Ward to inspect the entire land use status of Mr. Suu's family, consider and issue a land use right certificate according to the provisions of the Land Law.

Citizen Nguyen Nhu Chung (son of Mr. Nguyen Nhu Ky - the person authorized to resolve the case) expressed his opinion.

At the dialogue, the Working Group also considered the case of citizen Nguyen Nhu Chung (son of Mr. Nguyen Nhu Ky), residing in Thai An Sub-area, Phu Luong Commune.

According to the complaint, in 1966, the family cleared a 7,000m2 plot of land in Dong Kho Mountain, Du Town, Phu Luong District for cultivation. In 1993, the family registered to implement Project 327 to grow tea and fruit trees. On September 21, 2003, the People's Committee of Phu Luong District allowed Song Lo Enterprise (the construction unit of National Highway 3) to level the land the family was using.

Mr. Nguyen Nhu Ky's family believes that when leveling the land, there must be a decision to reclaim and compensation must be paid according to regulations. Since then, Mr. Ky's family has sent a request and complaint to the People's Committee of Phu Luong district and state agencies.

The complaint of Mr. Nguyen Nhu Ky was resolved by the Chairman of Phu Luong District People's Committee (first time) in 2006 and by the Chairman of the Provincial People's Committee (second time) in 2008 in accordance with the correct procedures and legal regulations, ensuring the legitimate rights and interests of citizens.

Mr. Nguyen Nhu Ky's family has received the full amount of compensation and support for reproducing on the land with an amount of over 53.7 million VND. The settlement result also clearly stated that the request for compensation for an area of 7,000m2 of land under the Loan Contract signed with Phu Luong Farm to implement Project 327 must have a decision to recover and implement compensation according to regulations is not a basis for settlement.

At the dialogue session, the relevant departments and agencies discussed and clarified this proposal. Based on the family's opinions and the results of the meeting, the Working Group agreed to continue the review and requested Mr. Nguyen Nhu Ky's family to cooperate in providing additional relevant records and documents to serve the verification work according to regulations.
