Institutional breakthroughs to unleash all resources for the country to develop strongly

NDO - On December 4, at the Government Headquarters, Prime Minister Pham Minh Chinh chaired a special Government meeting on law-making in November 2024 to discuss and give opinions on 6 proposals for law-making, including: Law amending and supplementing a number of articles of the Law on Organization of the Government; Law amending and supplementing a number of articles of the Law on Organization of Local Government; Law on Atomic Energy (amended); Law amending and supplementing a number of articles of the Law on Execution of Criminal Judgments; Law on Execution of Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy; and the draft Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site.

Concluding the meeting, Prime Minister Pham Minh Chinh requested the Ministers to seriously absorb the opinions of the Government members and delegates, and complete the proposals, draft laws and ordinances according to regulations; the Ministry of Justice shall preside over and coordinate with relevant ministries and agencies to continue reviewing and detecting problems and inadequacies in the system of legal documents, propose amendments, supplements and remove "bottlenecks"; the Prime Minister requested the Deputy Prime Ministers in charge of their respective fields to pay attention and absorb the maximum opinions, continue to perfect and improve the quality of draft laws; assign the Government Office to preside over and coordinate with relevant ministries and branches to fully absorb the opinions, perfect and submit to the Government to issue the Resolution of the meeting for unified implementation.

Regarding the key tasks of institutional work in the coming time, the Prime Minister requested to continue summarizing practices to evaluate policies; concretizing and institutionalizing the Party's guidelines; discovering and removing bottlenecks and obstacles through practice to contribute to unlocking resources for national development. According to the Prime Minister, institutions, mechanisms and policies are the driving force and resources for development, therefore, it is necessary to change the mindset of law-making, both to manage and to open up, to mobilize resources for national development, especially in the coming period when we set a double-digit growth target.

Review and resolutely eliminate the mechanisms of asking and giving, which can easily create negativity; fight corruption and negativity in the process of building laws and ordinances; review and do not criminalize economic relations, protect the legitimate rights and interests of people and businesses; express them concisely, easily understood, sharply, clearly, with clear meaning, clear authority, clear responsibility, easy to check, easy to monitor; strengthen decentralization and delegation of authority, coupled with resource allocation, improve enforcement capacity, increase post-inspection, reduce pre-inspection.

The Government and ministries and branches only focus on state management, policy and law making, and building tools to monitor law enforcement. Minimize administrative procedure costs for people and businesses; increase the application of science and technology, digital transformation, reduce contact, reduce direct travel and transactions, reduce negativity and petty corruption; continue to seek opinions from affected subjects, scientists, experts, and international experience; do a good job of policy communication on difficult issues.

The Prime Minister requested coordination and proposals from agencies in the political system to amend relevant laws for more convenient implementation; requested the urgent implementation of laws and resolutions passed by the National Assembly at the 8th session and a number of laws passed by the National Assembly at the 7th session; Ministers, heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally run cities focus on directing the timely drafting and promulgation of detailed documents guiding the implementation of laws and resolutions passed by the National Assembly. Ministers, heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally run cities continue to review promulgated laws that have problems, are outdated compared to reality or have things that reality already has but the law has not yet provided for in order to perfect the legal system.

Ministries, sectors and local authorities must thoroughly grasp the requirements for innovation in the development and promulgation of legal documents; continue to tighten discipline, order and control power in law-making; Ministers and sector heads not only need to spend time developing laws for their sectors but also give comments to other sectors in the political system, especially agencies under the Government; prioritize human resources, facilities, leadership and direction for this work; during the implementation process, it is necessary to detect bottlenecks and obstacles, "where there are obstacles, there must be solutions", "where there are obstacles at which level, that level must proactively resolve them, if beyond authority, it must be reported".

The Ministry of Justice and the Government Office monitor and urge relevant agencies and localities to implement laws and resolutions passed by the National Assembly; assign tasks to prepare for the upcoming National Assembly session; overcome the situation of postponement, withdrawal, delay, and poor quality of draft laws. In the coming time, we must focus on amending the Law on promulgation of legal documents, which is a bottleneck and a bottleneck, so it is necessary to review the practice and quickly amend this law in a simple, practical spirit, avoiding unnecessary complexity.
