The Ministry of Finance proposes specific road use fee rates collected through vehicle heads for automobiles.
The Ministry of Finance said that in Article 5 of Decree No. 90/2023/ND-CP dated December 13, 2023 of the Government stipulating the collection rates, collection, payment, exemption, management and use of road use fees. (Decree 90) stipulates: Road use fee rates are specified in Appendix I issued with this Decree.
In Appendix I of the Fee Schedule issued with Decree 90 , the fee for civil vehicles is from 130,000 VND to 1,430,000 VND/month (applied for periods of 1 month, 3 months, 6 months, 12 months, 18 months, 24 months). month); vehicles of national defense and police forces from 1,000,000 VND to 1,500,000 VND/year.
The Ministry of Finance said that the Ministry of Construction has proposed:
(1) Change the concepts: "passenger vehicle with less than 10 seats" to "passenger vehicle with up to 8 seats (excluding the driver's seat)", "passenger vehicle with less than 25 seats" to "passenger vehicle with up to 24 seats (excluding the driver's seat)", "passenger vehicle with less than 40 seats" to "passenger vehicle with up to 39 seats (excluding the driver's seat)" to ensure compliance with the provisions of the Law on Road Traffic Order and Safety 2024 and detailed regulations.
(2) For public passenger transport vehicles: it is proposed to remove the phrase "like a bus" and add a note at the bottom of Appendix 01 as follows: "- The vehicle owner is responsible for providing the inspection unit with a badge (still valid) proving that it is a public passenger transport vehicle or documents related to proving that it is a vehicle transporting students, workers and enjoying the subsidy policy". Reason: Currently, there are subsidized and non-subsidized public passenger transport vehicles. If it is written as it is now, it can be understood that only vehicles enjoying the subsidy policy like buses will be subject to the collection rate of 180,000 VND. On the other hand, the regulation does not clearly stipulate the responsibility of the vehicle owner to provide a badge proving that it is a public passenger transport vehicle or documents related to proving that it is a vehicle transporting students, workers.
(3) According to Article 42 of the 2024 Law on Road Traffic Order and Safety , automobiles participating in road traffic must be inspected in accordance with the provisions of law and the Minister of Transport shall prescribe the order and procedures for inspection, exempting the first inspection for automobiles, accordingly, the inspection cycle of automobiles is 3 months, 6 months, 12 months, 24 months and 36 months (the inspection cycle is determined by the type of vehicle and the time of manufacture). Therefore, it is necessary to remove the fee collection rate according to the 18-month inspection cycle and add the fee collection rate according to the 36-month inspection cycle in the Fee Collection Schedule.
Therefore, to ensure compliance with specialized laws and ensure fairness for public passenger vehicles, the Ministry of Finance proposes to amend and supplement a number of phrases as proposed by the Ministry of Construction mentioned above; remove the fee collection rate according to the 18-month inspection cycle and add the fee collection rate according to the 36-month inspection cycle at Point 1 of the Fee Collection Schedule Appendix I issued with the draft Decree.
