(Chinhphu.vn) - The Government has issued Decree No. 321/2025/ND-CP dated December 16, 2025, guiding the process of soliciting public opinion on the establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units.

Guidelines for soliciting public opinion on the establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units.

This Decree regulates the organization of public consultations on the establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units.

The establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units must be subject to public consultation in the commune-level administrative units directly affected, specifically:

In cases of establishment, dissolution, merger, division, boundary adjustment, and renaming of provincial-level administrative units, the Provincial People's Committee shall organize the collection of public opinions in all commune-level administrative units within that provincial-level administrative unit.

In cases of establishment, dissolution, merger, division, boundary adjustment, and renaming of commune-level administrative units, the provincial People's Committee shall organize the collection of opinions from the people in that commune-level administrative unit.

The provincial People's Committee shall organize the collection of public opinions by distributing household opinion survey forms according to the mẫu prescribed in the Appendix attached to this Decree and the provisions of the law on the implementation of democracy at the grassroots level.

Based on the local situation, the Provincial People's Committee shall decide on appropriate methods for distributing opinion survey forms to each household, or delegate the decision to the Commune People's Committee for each specific unit. The application of electronic opinion survey methods through local websites, portals, or legally operating telecommunication networks, social networks, and electronic software as prescribed by law is encouraged, ensuring transparency, convenience, and suitability to the level of information technology application at the commune, village, and neighborhood levels.

Procedures for soliciting opinions

The decree stipulates the procedures for soliciting public opinion as follows:

After developing the plan for establishing, dissolving, merging, dividing, adjusting boundaries, and renaming administrative units, the provincial People's Committee shall send a document, along with a sample opinion form and opinion collection materials, to the commune-level People's Committee; and direct and guide the commune-level People's Committee to develop a plan and organize the collection of public opinions in each village and residential area.

Within 60 days of receiving the document from the Provincial People's Committee, the Commune People's Committee shall complete the process of gathering public opinions.

Within 05 working days from the date of completion of the public consultation, the People's Committee of the commune shall compile and prepare a report on the results of the public consultation in the area and send it to the People's Council of the same level, the People's Committee of the province, and the website or portal of the People's Committee of the commune.

For commune-level administrative units that do not have a People's Council, the commune-level People's Committee shall compile and prepare a report on the results of the public consultation in the area and send it to the provincial-level People's Committee and also to the commune-level People's Committee's website or electronic portal.

Within 05 working days from the date of receiving the report on the results of the public consultation from the People's Committee at the commune level, the Provincial People's Committee shall direct the preparation of a consolidated report on the results of the public consultation from the directly involved commune-level administrative units and send it to the People's Council at the same level, the Government's electronic information portal, and the website and electronic information portal of the Provincial People's Committee.

Within 05 working days from the date of receiving the report on the results of the public consultation from the People's Committees at the provincial and commune levels, the Government's electronic information portal and the websites and electronic information portals of the People's Committees at the provincial and commune levels are responsible for publishing the results of the public consultation.

The merger and renaming of provinces and communes must be approved by at least 50% of the households before the plan can be finalized.

The report on the results of public consultation regarding the establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units must clearly state the consultation process, the total number of households in the area, the number of households participating in the consultation, the number of households agreeing, the number of households disagreeing for each commune-level administrative unit, and other opinions (if any).

If the results of the public consultation on the establishment, dissolution, merger, division, adjustment of administrative boundaries, and renaming of provincial-level administrative units show that 50% or more of the total number of households in the area (calculated for each provincial-level administrative unit) approve, the agency developing the proposal will continue to refine the proposal and submit it to the Provincial People's Council for consideration and feedback.

If the results of the public consultation on the establishment, dissolution, merger, division, boundary adjustment, and renaming of commune-level administrative units receive approval from 50% or more of the total number of households in the area (calculated for each commune-level administrative unit), the agency developing the proposal will continue to refine the proposal and submit it to the provincial and commune-level People's Councils for consideration and comments. In cases where a commune-level administrative unit does not have a People's Council, the provincial People's Committee will direct the refinement of the proposal and submit it to the provincial People's Council for consideration and comments.

The results of the public consultation must be publicly disclosed on local websites and portals, as well as on the Government's electronic portal, in accordance with Clause 5, Article 4 of this Decree and the provisions of the law on the implementation of grassroots democracy.

Receiving and processing feedback on the results of public consultations.

When errors are discovered in the results of the public consultation, citizens and organizations have the right to submit a petition to the People's Committee of the locality where the public consultation report was prepared. Within 05 working days from the date of receiving the petition, the People's Committee of that locality must resolve the issue and inform the petitioner of the resolution.

In case errors are discovered in the results of the public consultation due to the process of compiling and preparing the report on the results of the public consultation, within 05 working days, the People's Committees at all levels shall correct, finalize, and amend the report on the results of the public consultation and send it to the competent authorities as prescribed in this Decree.

In case errors are discovered in the results of public opinion polls published on the Government's electronic portal and local websites and portals, the People's Committees at the provincial and commune levels shall send a written request to the Government's electronic portal and local websites and portals for correction. Within 3 working days from the date of receiving the written request from the provincial People's Committee, the Government's electronic portal and local websites and portals shall be responsible for correcting the results of the public opinion poll.

This Decree shall take effect from December 16, 2025.
