Is it correct for teachers to bring regular students to the center to teach?

(Dan Tri) - Is it considered in accordance with Circular 29 for teachers to bring regular students to the center to teach directly but collect money indirectly through the center?


Circular 29 regulating extra teaching and learning has been effective since February 14. However, many parents are concerned that extra teaching and learning will only be "temporarily suspended" or "postponed" for a while and will transform in many different ways.

On social media forums, parents have reported cases of teachers cooperating with non-school centers to legally enroll regular students. Teachers still teach their students directly at the center, but the center collects the money.

Parents asked: "Parents still pay tuition fees but teachers are not the ones who receive the money directly. So are teachers violating Circular 29 or not?"

In this content, Circular 29 clearly states: "Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned by the school to teach according to the school's education plan."

Thus, if a teacher teaches "his" regular students and the students' parents have to pay for that lesson, then whether the teacher directly or indirectly receives the money through the tutoring facility is a violation of the regulations.

Deputy Minister of Education and Training Pham Ngoc Thuong also clarified this content on the Ministry's information portal as follows:

"Regarding the regulations on extra teaching and learning outside of school, the new Circular stipulates: organizations and individuals organizing extra teaching and learning with fees from students must comply with relevant legal regulations (registering business, declaring activities, providing relevant information to local authorities according to the provisions of law); teachers teaching at schools are not allowed to teach extra teaching outside of school with fees from their students in class...

The new regulation aims to ensure students' rights and avoid teachers "pulling" students out of class for extra lessons.

Another concern of parents is whether Circular 29 will be complied with by localities, schools, and teachers.

Mr. Hoang Minh Quan (Thanh Xuan, Hanoi) shared: "In 2013, when my eldest son was in 5th grade, the ban on extra tutoring and extra learning in primary schools was also widely reported in the newspapers.

But just a few months later, everything returned to "old normal". For the past 12 years, extra teaching and learning at primary schools has been open right in the center of the capital.

Not only teachers in schools teach extra classes, but also centers openly recruit students, openly open classes, openly tutor primary school students, and later openly advertise on social networks. But it seems that no center or teacher in Hanoi has been punished for tutoring primary school students.

So what guarantees us parents that Circular 29 will not be ignored like Circular 17, especially when the sanctions are not complete and clear?

Are parents who comply with the Circular at a disadvantage while many parents and teachers "cross the line" regardless?

Currently, teachers who are civil servants and violate regulations on extra teaching and learning will be handled according to Decree 112 of the Government on disciplinary action against cadres, civil servants and public employees.

Accordingly, the principal will base on the level of violation to decide on disciplinary action from reprimand, warning to dismissal.

In addition, teachers can be administratively fined from 5 to 10 million VND if they teach extra classes as a family business without registering their business, and from 25 to 50 million VND if they teach extra classes as a business without establishing a business.
