The city of Hai Phong is reviewing and seeking solutions to address shortcomings in the management and exploitation of riverside wharves and docks.

Many wharves and docks are operating illegally.

Mr. Pham Van Dieu's construction materials business at the foot of Quy Cao bridge along the Luoc River (Vinh Thuan commune, formerly Giang Bien commune) was leased from the commune's People's Committee for aquaculture purposes, but for many years he has arbitrarily converted it to a construction materials business, built a concrete mixing plant, violating the dike and flood control corridor. The lease contract has expired but has not been renewed.

At the foot of the Tram Bac bridge, there are also several operating wharves and docks that are being used improperly, arbitrarily transferred, bought, and sold through multiple owners, seriously violating the protection corridor of dikes, flood control structures, and ports… To this day, these wharves and docks continue to operate brazenly, failing to fulfill their obligations to the state.

In areas around Khue Bridge, Han Bridge, Dang Bridge, Hoa Bridge, Kien Bridge, Kien An Bridge, An Dong Bridge, Rao Bridge, etc., there are also many illegal construction material trading yards and depots.

According to a review by the Department of Agriculture and Environment, as of early October, Hai Phong city has a total of 725 wharves and docks along rivers and inland canals (684 wharves and docks along rivers, and 41 wharves and docks along inland canals). Of these, 337 wharves and docks are located in the eastern part of the city, and 388 in the western part. Of these wharves and docks, 329 are currently not in accordance with the planning regulations.

Inspections by relevant authorities have uncovered numerous violations related to investment, land, taxes, dikes, transportation, minerals, and the environment by owners of wharves and docks. Many cases involve non-compliance with legal regulations, unauthorized land use, and the conversion of land use for production and business activities without permits, affecting public order and causing revenue losses. Many households engaged in business activities are using land for purposes other than those stipulated in their land lease contracts with the commune/ward People's Committees.

Eliminate wharves and docks that do not conform to the planning regulations.

According to Bui Hung Thien, Deputy Director of the Department of Agriculture and Environment of Hai Phong City, after the merger with Hai Duong province, Hai Phong City currently has a total of 725 wharves and docks along rivers and inland canals. Of these, West Hai Phong has 331 out of 388 wharves and docks that conform to the planning (107 wharves and docks have complete legal procedures, 108 wharves and docks have legal procedures but not yet complete...). East Hai Phong has 65 out of 328 wharves and docks that conform to the planning (1 wharve and dock has complete legal procedures, 43 wharves and docks have legal procedures but not yet complete, 21 wharves and docks have no legal procedures).

The number of operating wharves and yards mainly serves the transshipment of construction materials, coal, scrap metal, and goods. Some wharves operate under business models, individual business households, or organizations leasing land from projects. However, the majority of wharves and yards are located in riverside areas, primarily on riverside land that has not been granted land use rights certificates or is currently being used temporarily.

In order to improve the efficiency of managing and operating wharves and storage areas, and to generate revenue for the local budget, the Department of Agriculture and Environment is currently coordinating with localities to review, compile, and classify each case and propose solutions to the City People's Committee. Accordingly, wharves and storage areas operating in violation of the planning will be resolutely removed and their operations stopped.

For wharves and docks that do not conform to the planning regulations, the Department of Agriculture and Environment proposes that the city and local authorities require the cessation of operations and organize their removal in accordance with regulations.

For wharves and yards that conform to the planning but lack complete documentation, local authorities and business owners are required to complete the necessary paperwork, compile a list, and include them in the planning, requesting the city to allow them to continue operating. Priority should be given to considering and deciding on the operation of wharves and yards for the collection of construction materials that directly serve key projects and public investment projects of the city, ensuring that they meet actual needs and comply with legal regulations.

For wharves and docks that conform to current planning but lack complete legal procedures, the People's Committees of communes, wards, and special zones will focus on guiding and resolving difficulties and obstacles to complete all legal procedures in accordance with the law, to be completed before December 31, 2026. From 2027, if the procedures are not fully completed, operations will be required to cease.

For wharves and docks that conformed to the previous planning phase but not to the current planning (provided all legal procedures have been completed), operations must cease upon the expiration of the project term or until the state reclaims the land to implement the new planning.

In cases where legal procedures exist but are incomplete, it is required to complete all legal procedures before December 31, 2026, and operations must cease upon the expiration of the project term or until the State reclaims the land to implement a new plan. For wharves and docks added to the plan, production and business activities may continue in accordance with the law.

For wharves and docks that do not conform to planning regulations at any time, the Department of Agriculture and Environment proposes that the city and local authorities require the cessation of operations and organize their removal in accordance with regulations.
