The Standing Committee of the National Defense and Security Committee basically agreed with the Government's report and found that the implementation of Resolution No. 73/2022/QH15 in the recent past has brought about positive results, proving the effectiveness and feasibility of this new policy. If this Law is not promptly included in the draft Law but waits until the end of the pilot implementation period, conducts a summary, and reports to the National Assembly , then the procedures for amending and supplementing the new Law must be carried out by the National Assembly, which will be costly and wasteful in terms of both time and budget.
Based on the Government 's proposal, the Standing Committee of the National Defense and Security Committee proposed two options to legalize the content of vehicle license plate auctions. Specifically, option 1 adds 1 article (Article 37) to the draft Law on Road Traffic Safety and Order in the spirit of inheriting the content of Resolution No. 73/2022/QH15 on piloting vehicle license plate auctions with adjustments to overcome difficulties and obstacles in the implementation of the above Resolution. Option 2 adds the content of vehicle license plate auctions to the draft Law amending and supplementing a number of articles of the Law on Property Auctions.
Chairman of the National Assembly's Committee for National Defense and Security Le Tan Toi said that the Standing Committee of the National Defense and Security Committee agreed with option 1, because including the regulation in the draft Law on Road Traffic Safety and Order is consistent with the opinions of the National Assembly deputies, consistent with the scope of regulation of the draft Law on Road Traffic Safety and Order, which is a specialized law, will fully and specifically regulate the contents of vehicle license plate auctions and create consistency with other regulations on vehicle license plates such as management of road vehicles, issuance and revocation of vehicle registration certificates and license plates.
Regarding the above issue, according to Ms. Nguyen Thi Thanh - Head of the Delegation Affairs Committee of the National Assembly Standing Committee, Resolution 73 has brought about very positive results in the past time, proving the effectiveness and feasibility of the new policy. In 5 months of implementation, 15,185 license plates were successfully auctioned online, with a total auction amount of 2,052 billion VND, and 1,4062 license plates were auctioned and paid by customers with the amount of 1,395 billion VND. The auction of license plates has received much attention and support from public opinion. Therefore, legalizing the regulations on license plate auctions is very necessary.
However, according to Ms. Thanh, Article 7 of Resolution 73 stipulates that the resolution will take effect from July 1, 2023 and will be implemented for 3 years. Clause 4 stipulates: The Government shall specify detailed instructions for implementation and be responsible for organizing the implementation of this resolution and reporting to the National Assembly the results of the summary of the implementation of the resolution proposing the completion of the law on vehicle license plate auctions at the first session of 2026.
“Based on Resolution 73, the Government and the National Defense and Security Committee need to assess the impact more carefully and explain this content more thoroughly to report to the National Assembly in legalizing the regulations on vehicle license plate auctions. Resolution 73 has been implemented for less than a year, so it is necessary to assess the impact and explain more thoroughly. If possible, the law on auctions should be improved, and vehicle license plates are assets. Therefore, it is more appropriate to "legislate" the law on property auctions as the Law amending and supplementing a number of articles of the Law on Property Auctions,” Ms. Thanh stated her opinion.
