Head of the Department of Strategy Research and Economic Management Mechanism of the Industry, Institute of Construction Economics ( Ministry of Construction ), Master Vu Quyet Thang shared that the draft Decree replacing Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing a number of contents on the management of construction investment projects, new construction works of level II belonging to group B projects or higher will have to apply the construction information model (BIM) in the coming time.

This new orientation is also consistent with the Prime Minister 's roadmap for applying BIM phase 2, implemented from 2025, stipulated in Decision No. 258/QD-TTg dated March 17, 2023 on the roadmap for applying BIM in construction activities.

Also according to the draft decree, for projects not subject to mandatory application, investors are encouraged to proactively apply BIM and provide BIM files to update the national database on construction activities.

BIM data is a digital resource created, managed and exploited during the implementation of a construction project. The scope, implementation content and necessary information requirements of BIM for BIM-applied works will be implemented according to the agreement stated in the contract of the relevant parties at each stage of the project and meet the requirements to support State management of construction works.

Regarding the benefits of supporting State management, according to Mr. Vu Quyet Thang, construction professional agencies can use BIM data to support the process of appraising feasibility study reports, appraising construction designs implemented after basic design, and granting construction permits.

For construction works of special scale, level I (belonging to the subjects specified in Clause 6, Article 82 of the Construction Law, amended and supplemented in Clause 24, Article 11 of Law No. 62/2020/QH14) and works requiring design appraisal during the appraisal process at specialized construction agencies, the construction design appraisal results must include an assessment by the appraisal consulting unit on the consistency of the BIM model with the calculation and design results shown in the dossier submitted for administrative procedures.

Lawyer Pham Viet Thai - Hanoi Bar Association acknowledged that the draft Decree replacing Decree No. 15/2021/ND-CP on construction investment project management has many important reform points, especially in the application of information technology and BIM, improving construction quality management, improving the project appraisal and approval process, along with environmental protection.

The draft will clarify provisions relating to dispute resolution in construction contracts, including the handling of breaches of contract, liability for damages and the settlement of complaints relating to construction quality. The new provisions will need to be agreed upon and strictly implemented by contractors, investors and other stakeholders, which requires a thorough process of communication and explanation.

In fact, with the integration of digital transformation in the construction industry, BIM has been applied and is becoming more and more popular, bringing positive effects in the implementation of investment projects. However, many construction enterprises and design consultants face a lack of uniformity in legal requirements and construction regulations; bidding documents; costs of applying new technology as well as having to adjust the BIM model to comply with new regulations or unclear technical standards.

Mr. Vu Quyet Thang informed that on April 2, 2021, the Ministry of Construction announced Decision No. 348/QD-BXD promulgating general guidelines for applying BIM in construction activities and Decision No. 347/QD-BXD providing detailed guidelines for applying BIM to civil works and urban technical infrastructure.

In case the investor does not have the capacity or experience, they can hire a consulting unit to review and evaluate the level of compliance of the BIM building information model according to the criteria of the contract signed between the investor and the consulting unit, including the content of evaluating the consistency of the BIM model with the calculation results as well as traditional design documents to submit to the State management agency.

If the investor cannot evaluate the BIM model that the design submitted to the investor meets the requirements in the construction consulting contract, the investor can hire a consultant to help the investor evaluate whether the BIM model and BIM products meet the requirements of the signed contract or not.

Autodesk ASEAN Technical Director Sagar Thorat said that the common data environment (CDE) is an important solution to address shortcomings in the bidding and acceptance process of projects applying BIM.

The benefits of CDE in BIM project management will create information transparency, with a single platform for all stakeholders, ensuring all project data and documents are stored, shared, and updated in real time. With a centralized management system, CDE helps minimize errors arising from inconsistent information or not being transmitted in a timely manner.

At the same time, it improves work efficiency in the bidding and acceptance process, allowing for continuous project supervision, from the design stage to construction and completion, ensuring standards are strictly adhered to.
