Although they have built houses and fulfilled their financial obligations as prescribed, for many years now, people living in the new urban areas of Le Hong Phong I and II (invested by Ha Quang Real Estate Joint Stock Company) have not been granted land use right certificates (red books). Recently, the People's Committee of Khanh Hoa province has issued a document requesting the Department of Natural Resources and Environment (TN-MT) to urgently complete the determination of land prices in these two urban areas to proceed with the procedures for granting red books to people.
Waiting for the red book
For nearly 10 years now, although many households have bought land and built houses in the two new urban areas of Le Hong Phong I and II, very few households have been granted red books, of which no household in the new urban area of Le Hong Phong II has been granted a red book. Ms. Nguyen Thi Hai Dung (in the new urban area of Le Hong Phong II) said that her family bought land and built a house in 2017, fulfilled financial obligations to the investor, completed all procedures, accepted the house and completed the construction, but up to now, the house she lives in has not been granted a red book. All households in this urban area are like that.
According to the report of Ha Quang Real Estate Joint Stock Company, in 2012, Le Hong Phong I New Urban Area was granted 45 total certificates, equivalent to 12.3 hectares. By 2018, the company had returned all 45 total certificates to the Department of Natural Resources and Environment to be resolved to change according to the 1/500 planning approved by the Provincial People's Committee in 2016. However, the company has only been temporarily granted 3.7/12.3 hectares. The company has repeatedly requested to change the full 12.3 hectares, but so far it has not been resolved. According to the planning, Le Hong Phong I New Urban Area has 1,391 adjacent lots and villas. To date, 357 houses have been built, but only 173 separate certificates have been granted to customers. Recently, the Department of Natural Resources and Environment has issued a document refusing to process the application for a Certificate of Low-rise Housing at the Le Hong Phong I New Urban Area Project due to the implementation of the Provincial People's Committee's review direction regarding the issuance of land use right certificates for the HQS Social Housing Project, even though there are cases where the registration fee has been paid. In the Le Hong Phong II New Urban Area, according to the plan, there are 2,506 townhouses and villas. To date, although 1,217 houses have been completed, none have been granted a red book. The reason is that the competent authority has not approved the land use price, even though the company has temporarily paid 150 billion VND to the state budget and advanced more than 300 billion VND for compensation and site clearance.

Mr. Ha Van Hai - General Director of Ha Quang Real Estate Joint Stock Company said that since 2016, the authorities have not issued a decision approving the land price and land rent of the Le Hong Phong II New Urban Area, causing many difficulties for the investor. Since 2018, the company has continuously sent many documents to the authorities requesting early resolution of the land price approval as a basis for calculating land use fees for the company to issue red books to home buyers in the two urban areas, but so far it has not been resolved. The company has had great difficulty explaining to the people issues related to the procedures for granting land use right certificates. The company hopes that the Provincial People's Committee will direct relevant departments and branches and the Provincial Land Valuation Council to promptly resolve the problems to determine the land price as a basis for calculating land use fees and land rents at these two projects.
Urgent completion of land valuation
According to the report of the Department of Natural Resources and Environment, the Le Hong Phong II New Urban Area Project has been fully completed and put into operation; the investor has carried out land procedures in accordance with current regulations. In particular, this project has had its detailed construction planning adjusted 6 times by the Provincial People's Committee and land procedures have been adjusted 6 times according to the detailed construction planning, but up to now, there have been no regulations on land prices to fulfill financial obligations. The Department of Natural Resources and Environment is urging the consulting unit, VFA Vietnam Valuation Company, to promptly have the results of land valuation for the first payment of land use fees and land rent. It is expected that before May 31, it will be submitted to the Provincial Land Valuation Council.
In addition, following the guidance of the General Department of Land Management (Ministry of Natural Resources and Environment), the Department of Natural Resources and Environment has sent documents and discussed with the consulting unit to determine the land price to collect the difference in land use fees and land rent for the Le Hong Phong I New Urban Area Project. MHD Valuation Company Limited has completed the land price plan and has the results of land price determination. After that, the Land Valuation Council returned the file for inspection and complete research on the following contents: Purpose of land price determination, time of land price determination, validity of land valuation certificate, conformity of collected information for commercial service land, land price for construction of public works. The consulting unit is urgently implementing to have a basis to submit to the Land Valuation Council for appraisal and submit to the Provincial People's Committee for approval.
Recently, the Provincial People's Committee has sent a document to the Departments of Construction, Planning and Investment, and Natural Resources and Environment to direct the early resolution of problems at the Le Hong Phong I and II New Urban Area Project. The document states: In the past, the Provincial People's Committee has sent many documents requesting the Department of Natural Resources and Environment to urgently complete the determination of land prices to calculate land use fees and land rents for the Le Hong Phong I New Urban Area Project and the Le Hong Phong II New Urban Area Project. However, up to now, the Department of Natural Resources and Environment has not yet completed the instructions of the Provincial People's Committee. Therefore, the Provincial People's Committee requests the Department of Natural Resources and Environment to urgently complete the determination of land prices at the above two projects.
