Proposal to adjust land use fee calculation method, digitize pink book issuance

On May 26, the Institute of Natural Resources and Environmental Economics sent a document to the Prime Minister, the Ministry of Agriculture and Environment and the Ho Chi Minh City Party Committee proposing to digitize land use right certificates (pink books).

According to the Institute of Natural Resources and Environment Economics , to make it more convenient for people and better for the State to manage land systematically, it is advisable to orient digital transformation by identifying land plots and maps integrated into the owner's ID card number.

This helps the State management agency manage planning, construction and collect real estate tax when transferring and even avoid falsifying land use right certificates. This proposal is consistent with the provisions of the 2024 Land Law on the national land information system.

In addition, the Institute of Natural Resources and Environmental Economics proposed to adjust a number of provisions in Decree 103/2024 of the Government on regulations on land use fees and land rents.

Specifically, in the process of drafting Decree 103/2024 , the Ministry of Finance requested the Ministry of Natural Resources and Environment (now the Ministry of Agriculture and Rural Development) to provide data for drafting with the goal of not causing a sudden increase in land use fees in localities.

However, the calculation of land use fees when changing land use purposes for households and individuals in Article 8 of Decree 103/2024 has increased dozens of times compared to before the Land Law took effect. Currently, very few people across the country complete procedures to change the purpose to residential land because the land use fee for changing purposes is too high, in some localities it is nearly 20 times higher than the 2013 Land Law.

Practical research experience shows that in the process of drafting Article 8 of Decree 103/2024, the percentage multiplication calculation (%), which is the scientific calculation in the coefficient "K" or coefficient "K...n", leads to inconsistency between Article 8 and Article 9 of Decree 103/2024.

Therefore, the Institute of Natural Resources and Environmental Economics recommends that the Government review and objectively reassess the existing consequences due to the impact of Decree 103/2024, such as not being able to collect land use conversion fees in the fourth quarter of 2024 and the first quarter of 2025.

This also greatly affects the country's double-digit growth target, affects efforts to develop the private economy according to Resolution 68 and the country's real estate market due to high land prices.
