What are the options for one-time social insurance withdrawal?

Regarding the content of receiving one-time insurance benefits, according to Minister Dao Ngoc Dung, "this is completely absent from the Insurance Law of countries, especially developed countries".

Minister Dao Ngoc Dung explained that the design of this regulation was based on the needs of workers. Resolution No. 93/2015/QH13 (on the implementation of the policy of receiving one-time social insurance benefits for workers) was issued when the Social Insurance Law 2014 had not yet taken effect, to resolve the situation at that time.

But now, Resolution No. 93 cannot be abandoned because it will give rise to very complicated political and social consequences. Therefore, according to the Minister, it should be maintained but on the basis of calculations to achieve two goals: Ensuring long-term social security for the country, so that when the elderly retire, they all have salaries and health insurance; at the same time, we must also pay attention to the current real life of workers, because the wish of a part of workers is to withdraw social insurance.

With the above objectives, the Government has proposed two options (through many consultations with international organizations, organizing workshops and conferences). On May 25, the Government continued to give opinions on this content and found that there were no other options other than the two options mentioned in the draft law.

Through studying the proposed opinions, we also calculated the integration of the two options as analyzed by some delegates. Accordingly, those who are currently paying will continue to enjoy the same benefits as option 1; those who pay later will enjoy the benefits according to option 2. However, after consideration, experts evaluated and said that if we add the two options, we will add more disadvantages than advantages. Therefore, the Government continues to submit to the National Assembly a proposal to choose one of the two options that the Government submitted.

“Moreover, since the 6th Session, the review agency and the drafting agency have widely solicited opinions. In particular, through the reports of 5 localities with high rates of one-time insurance withdrawal, the vast majority of opinions chose option 1, very few people proposed option 2. The Ministry also agrees with the opinions of delegates that, along with having a policy to limit one-time social insurance withdrawal, we have many solutions, including policies to support workers,” the Minister emphasized.

Responding to concerns of some delegates about the "reference level", according to Minister Dao Ngoc Dung, the nature of the "reference level" is a new concept replacing the basic salary, because Resolution No. 27 clearly states that the basic salary is abolished.

According to Minister Dao Ngoc Dung, there is no problem with the regulation of a reference level instead of the basic salary. If necessary, the current basic salary of 1.8 million VND can still be applied. But if the basic salary is abolished, what will replace it?

Regarding the calculation of pensions in the armed forces sector, Minister Dao Ngoc Dung said he acknowledged this opinion and will report it to the competent authority.

Regarding the issue of retirement, Minister Dao Ngoc Dung said, the Government Standing Committee has met and the Ministry proposed that pensioners from July 1 until the salary reform for cadres, civil servants and public employees, should also apply the highest possible level.

"Maybe in the last 6 months of this year and early 2025, we will balance the fund, with no surplus. Accept that to ensure the rights of retirees," Minister Dao Ngoc Dung affirmed.

For people with meritorious services and social protection beneficiaries, Minister Dao Ngoc Dung said it will be one level higher than for workers and civil servants.
