Decree 289/2025/ND-CP: Realizing breakthroughs in law making and enforcement

(Chinhphu.vn) - The Government has just issued Decree No. 289/2025/ND-CP, which is a specific and important step in realizing the goal of innovation, creating a breakthrough in the work of building and organizing law enforcement in practice with many new points and important highlights on financial mechanisms.

To clarify the important highlights of Decree 289/2025/ND-CP of the Government dated November 6, 2025, signed and issued by Deputy Prime Minister Ho Quoc Dung, a reporter from the Government Electronic Newspaper had an interview with Mr. Nguyen Hong Hai, Director of the Department of Civil and Economic Law, Ministry of Justice, on this issue.

- The Government has just issued Decree No. 289/2025/ND-CP guiding the implementation of Resolution No. 197/2025/QH15 of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law making and enforcement. So, could you please tell us what are the new and important highlights in this Decree?

Mr. Nguyen Hong Hai: In recent times, competent authorities have shown great interest and political determination in building and perfecting institutions and laws. In a short time, we have had documents related to innovation, creating breakthroughs in the work of building and organizing law enforcement, from Resolution No. 66-NQ/TW of the Politburo to Resolution No. 197/2025/QH15 of the National Assembly, and recently Decree No. 289/2025/ND-CP of the Government.

In particular, the Government's issuance of Decree No. 289/2025/ND-CP can be said to be a concrete step, an important realization in implementing the goal of innovation, creating a breakthrough for the work of building and organizing law enforcement into practice in accordance with the spirit of Resolution No. 66-NQ/TW and Resolution No. 197/2025/QH15, with new points and important highlights on financial mechanisms.

These include: Simplifying and shortening the time, order, and procedures for payment and settlement so that agencies and units performing assigned tasks and activities can focus more time on performing professional work on the basis of applying the payment and settlement mechanism according to the lump sum method for each task and activity on completed products;

Strengthen and improve the ability to reasonably attract high-quality human resources to participate in law-making work with the mechanism of applying remuneration and contracting; create a mechanism to attract legal socialized funding sources from domestic organizations and individuals in addition to the funding sources guaranteed by the state budget through the Fund for supporting policy and law making, thereby ensuring more funding sources, promptly responding to projects, tasks, and activities that have not been funded by the state budget or need additional funding to create breakthrough, positive, effective, and sustainable changes in law-making...

- Decree No. 289/2025/ND-CP is expected to create a breakthrough in law making and enforcement. What special mechanisms and policies are designed to ensure flexibility and substance in law enforcement, sir?

Mr. Nguyen Hong Hai: On the basis of closely following the goal of creating a breakthrough in law-making, ensuring both substance and effectiveness as well as flexibility and convenience in implementation has been raised throughout the process of building the Decree.

In particular, to ensure flexibility and substance in implementation, in addition to the general principles that must be followed in applying special mechanisms and policies built on the basis of closely following the guiding viewpoints in Resolution No. 66-NQ/TW, the principles in Resolution No. 197/2025/QH15, Decree No. 289/2025/ND-CP have made transparent the list of tasks and activities in drafting legal documents and organizing law enforcement, applying remuneration and contracted hiring associated with contracted expenditure norms; on applying the contracted expenditure method with specific payment and settlement records...

In addition, flexibility in implementation is also ensured when the Decree stipulates and recognizes the rights of heads of units performing tasks and activities in deciding to adjust expenditure contents and expenditure norms in performing tasks and activities; on the heads of competent agencies to develop orders and decisions of the President, resolutions of the Council of Judges of the Supreme People's Court, circulars, joint circulars, resolutions of People's Councils at all levels, decisions of People's Committees at all levels, decisions of People's Committees at provincial level to proactively decide or issue regulations/statutes for application, in accordance with the diversity of types of documents as well as the practical implementation of tasks and activities at agencies and units...

- The Decree stipulates the list of tasks, activities and expenditure quotas for each task and activity in the development of legal documents and international treaties. How do you evaluate this provision? What is the impact of this Decree on the quality and progress of the development of legal documents and the efficiency of the use of the state budget, sir?

Mr. Nguyen Hong Hai: The Government's specific regulations on the list, tasks, activities and expenditure quotas for each task and activity in drafting legal documents and international treaties in Decree No. 289/2025/ND-CP are consistent with the content assigned by the National Assembly in Resolution No. 197/2025/ND-CP.

In terms of implementation, this is an important basis to create favorable conditions for relevant entities to base on and implement, ensuring the prompt implementation of policies, guidelines and strategies of competent authorities into practice, thereby promoting the progress and quality of law-making and law enforcement.

On the contrary, this concretization is also the basis for ensuring inspection and control, ensuring the effectiveness of inspection and control, and ensuring the effective use of the state budget.

- In order for Decree 289/2025/ND-CP to quickly become effective, in your opinion, what priority tasks should the Ministry of Justice and relevant agencies focus on in the coming time?

Mr. Nguyen Hong Hai: In order for Decree No. 289/2025/ND-CP to quickly become effective, ministries, ministerial-level agencies, government agencies, and other central and local agencies need to soon have plans to synchronously implement the mechanisms and policies in the Decree.

In particular, it is necessary to study, thoroughly grasp, ensure compliance with, and strictly implement the principles of applying special mechanisms and policies stipulated in Resolution No. 197/2025/QH15 and Decree No. 289/2025/ND-CP; based on the functions, tasks, and regulations in Article 7 of Decree No. 289/2025/ND-CP, promptly review and prepare estimates to report to competent authorities for decision in order to ensure timely, correct, sufficient funding, effective management and use, and compliance with legal regulations.

In addition, on the basis of the authority prescribed in the Decree, the Minister, Head of ministerial-level agency, Government agency, other central agency, Chairman of Provincial People's Council, Chairman of Provincial People's Committee shall, based on the practical implementation of tasks and related activities, consider and proactively issue guiding documents, regulations and internal rules, ensuring transparency and consistency in implementation.

On the part of the Ministry of Justice, in addition to organizing the implementation of specific tasks assigned by the Government in the Decree, we will closely coordinate with ministries, ministerial-level agencies, government agencies, and other central and local agencies in the process of organizing the implementation of mechanisms and policies in the Decree, ensuring the goal of innovation and creating breakthroughs in law-making.
