
Recently, the Ministry of Home Affairs announced that on the occasion of National Day, September 2, officials, civil servants, public employees and workers will have a 4-day holiday, from August 30 to September 2. The holiday includes 2 days off for National Day and 2 days off every week.
The Labor Law stipulates that from 2021, the whole country will have an additional National Day holiday, depending on each year the Government chooses to take a day off on the day before or after. This year, the day off is chosen as September 1. This schedule was announced at the end of last year.
Of which, there are 2 National Day holidays according to the Labor Code (September 1 and 2) and 2 weekend days (Saturday and Sunday). Therefore, on these two holidays, employees are off but still receive salary.
In 2025, officials, civil servants, public employees, and workers will have 22 days off for holidays and Tet, including 11 official days and 11 compensatory and swapped days off.
Agencies and units that do not have fixed days off on Saturdays and Sundays every week must arrange a suitable holiday schedule based on the specific program and plan of the unit, but must notify at least 30 days in advance.
For the National Day holiday on September 2, employers can choose a holiday option including Tuesday (September 2) and one of two days: Monday (September 1) or Wednesday (September 3) depending on the situation.
The Ministry of Home Affairs encourages employers to apply leave time for employees as prescribed for civil servants and public employees.
At the same time, agencies, units and localities must have specific and appropriate plans and measures to encourage units, enterprises, organizations and individuals to actively and proactively implement production, business, economic and social activities, ensuring stable supply and demand of goods, services, prices and markets, contributing to promoting production, business, economic growth, practicing thrift, fighting waste, striving to successfully implement the goals and tasks of the 2025 plan, the year of acceleration and breakthrough in implementing the 5-year plan 2021 - 2025, creating a solid foundation and premise for rapid and sustainable development in the coming time.
Besides the holiday schedule, one of the top concerns is the salary when employees work on holidays. According to the provisions of the Labor Code 2019, on holidays, employees are entitled to rest and receive full salary.
However, if they work on holidays, they will be paid overtime for the holidays. Specifically, according to Article 98 of the 2019 Labor Code:
Daytime work: When working on a public holiday, employees will be paid overtime wages at a rate of at least 300%, not including the holiday pay. This means that if working during the day, employees will receive at least 400% of their salary (including 100% of their normal working day salary + 300% of their holiday pay).
Night work: If employees work overtime at night on holidays, they will receive a higher salary according to regulations. Specifically, they will receive at least 490% of their salary (including 100% of their normal working day salary + 300% of their holiday salary + 30% of their night work salary + 60% of their overtime salary at night).
