If the State recovers the remaining land, the investor must commit to the progress and ensure financial capacity. If there are delays or violations, there must be sanctions to recover the project to avoid exploitation.

The Vice Chairman of the National Assembly requested that the draft Resolution should be written very briefly, only regulating the contents within the authority of the National Assembly, while the specific contents should be assigned to the Government to regulate and the Government should be responsible for investment capital, investment phases, and investment efficiency.

"We are in a world where we cannot go alone, integration requires openness in terms of institutions and policy mechanisms, the more open the more favorable it is, but at the same time it must be accompanied by the ability to control."

The delegate also said that one of the requirements of integration is the quality of cadres, especially diplomatic and foreign language skills. Therefore, it is necessary to clearly define the focal agency for unified state management of professional training for foreign affairs cadres, such as the Ministry of Foreign Affairs.

Commenting on the draft Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, National Assembly Deputy Nguyen Van Huy (Hung Yen) agreed with the additional content in the draft Resolution that the State reclaims land for socio-economic development for national and public interests in the cases specified in Point b, Clause 2 of Article 79 of the Land Law.

Specifically, in the case of using land to implement a project through an agreement on receiving land use rights that has expired, the agreement must be completed or the extension period must be completed, and over 75% of the land area and over 75% of the number of land users have been agreed upon. The Provincial People's Council shall consider and approve the recovery of the remaining land area to allocate or lease land to the investor.

According to delegate Nguyen Van Huy, this regulation will resolve the situation of projects being blocked due to some households not agreeing; at the same time, it will also help to handle the long-standing bottlenecks caused by some cases of non-cooperation, causing project stagnation and wasting resources; speed up socio-economic development projects, especially urban and industrial park infrastructure projects that often face difficulties in site clearance.

On the other hand, giving the provincial People's Council the right to consider and approve will also increase flexibility and suitability to local conditions, reduce procedures when asking for Central opinions. At the same time, it will limit the situation of investors having to buy land at escalating prices, being forced to pay lower prices, and reduce the situation of prolonged complaints.

However, delegate Nguyen Van Huy also pointed out that, although the rate of 75% has been stipulated, the administrative enforcement of the recovery of the remaining area needs to be carefully considered.

In addition, the determination of the criteria of 75% area and 75% number of households is still mechanical, not reflecting the actual situation; especially there is no mechanism to control the risk of investors taking advantage, leading to the situation where investors deliberately delay, create pressure, and rely on the State to recover in order to reduce the cost of the agreement.

Therefore, delegate Nguyen Van Huy suggested that it is necessary to study and supplement principles to ensure equal rights among households; stipulate that the area recovered by the State must be compensated at a level equivalent to the average agreed level of 75% of the collected area or apply a separate compensation framework reflecting market prices.

“At the same time, it is necessary to clearly define the method of calculating legal area and quantity for cases where households have multiple names, households are separated and land without certificates but have been used stably. Clearly define the responsibilities and post-inspection for investors. If the State recovers the remaining land, the investor must commit to progress and ensure financial capacity.
