NDO - On the morning of November 15, continuing the 39th Session, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law amending and supplementing a number of articles of the Law on Health Insurance.

The draft Law was discussed and commented on by the National Assembly at the 8th Session, with 137 opinions expressed in groups, 27 opinions expressed in the hall and 5 opinions in writing. Reporting at the session, Chairwoman of the Social Committee Nguyen Thuy Anh said that the major contents of the draft Basic Law have reached consensus among participating agencies. Regarding the subjects participating in health insurance , it is expected that Article 12 of the draft Law will be absorbed and revised in the direction of maintaining the subjects stipulated in the current Law; supplementing the subjects stipulated in other Laws, including the laws expected to be passed at this session such as the Law on Prevention and Combat of Human Trafficking (amended), the Law on Cultural Heritage (amended). At the same time, the subjects of village health workers and village midwives were added to encourage, motivate and have appropriate policies for the subjects of health care for people in remote areas and be fair to other subjects in residential groups. In addition, it has not been added to the draft Law on relatives of regular militiamen because the Law on Militia and Self-Defense Forces does not stipulate a health insurance regime for this subject but assigns the Government to stipulate other subjects after reporting to the National Assembly Standing Committee. After a period of stable implementation and full assessment, it will be studied and supplemented when the Law is comprehensively revised.

Article 13 of the draft Law has adjusted the regulations on health insurance contribution levels and responsibilities to synchronize with the amendment of health insurance participants. In particular, it stipulates that students continue to participate according to the group of subjects supported by the state budget to ensure stability when participating in health insurance for this group of subjects. Regarding the regulations on the scope of benefits, benefit levels, initial health insurance medical examination and treatment registration, transfer of health insurance medical examination and treatment facilities, taking into account the opinions of National Assembly deputies and to synchronize with the Law on Medical Examination and Treatment 2023, the draft Law has supplemented and clarified new forms of medical examination and treatment for which health insurance medical examination and treatment costs are paid, such as: remote medical examination and treatment; family medicine medical examination and treatment; medical examination and treatment at home. Participating in the discussion at the meeting, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the subjects participating in health insurance, Point e, Clause 3, Article 12 currently stipulates that people with revolutionary contributions and war veterans belong to the group whose health insurance is paid by the state budget. The Chairman of the National Defense and Security Committee proposed to add former people's police officers to the group whose health insurance is paid by the state budget.

Concerning the effectiveness of the law, Chairman of the Law Committee Hoang Thanh Tung said that according to Article 151 of the Law on Promulgation of Legal Documents, the effective date of all or part of a legal document is stipulated in that document but not earlier than 45 days from the date of approval or signing for legal documents of central state agencies. For this draft Law, with some contents taking effect from January 1, 2025, it will not ensure compliance with the Law on Promulgation of Legal Documents, so it is necessary to study the handling plan and fully explain it. Concluding the discussion, Vice Chairwoman of the National Assembly Nguyen Thi Thanh stated that the National Assembly Standing Committee highly appreciated the spirit of urgency, positivity, and coordination of the Social Affairs Committee, the Ministry of Health , the Law Committee, and relevant agencies in studying and absorbing the opinions of National Assembly deputies to revise the draft Law amending and supplementing a number of articles of the Law on Health Insurance. The amendment and supplement of a number of articles of the Law on Health Insurance has basically met the set goals and viewpoints, gradually institutionalizing the Party's guidelines and policies on health insurance, in sync and consistency with the provisions of the Law on Medical Examination and Treatment, and the Law on Social Insurance. To ensure feasibility, especially the new contents of the Law, the National Assembly Standing Committee requested the Government to direct the relevant agencies to do a good job of information and propaganda work so that all people, medical examination and treatment facilities, medical staff and relevant agencies and organizations clearly understand, fully and accurately implement the provisions of the Law, regularly inspect, supervise and monitor the implementation process to have solutions when necessary. The Vice Chairman of the National Assembly requested the Social Committee to absorb the comments, complete the Report on explanation, acceptance and revision of the draft Law to send to the National Assembly deputies.
