On the responsibilities of People's Committees at all levels
The 2024 Social Insurance Law has amended and supplemented the responsibilities of People's Committees at all levels, thereby inheriting the provisions of the 2014 Social Insurance Law into Clause 2 and adding a clause on the basis of legalizing the responsibilities of People's Committees at all levels in organizing the implementation of social insurance policies, developing participants, reducing the situation of late payment and evasion of compulsory social insurance payment within the locality.
Specifically as follows: "The People's Committee of Long An province is responsible to the People's Council of the same level in directing and organizing the implementation of social insurance policies, developing subjects participating in compulsory social insurance, voluntary social insurance and late payment of compulsory social insurance, and evasion of compulsory social insurance payment within the locality".
Regarding the responsibility of coordinating with social insurance agencies to organize the implementation of the task of determining social insurance participants (Clause 1, Article 30), determining compulsory social insurance participants and developing voluntary social insurance participants is one of the important tasks. The Social Insurance Law 2024 has specifically stipulated the responsibility of People's Committees at all levels to coordinate with social insurance agencies to organize the determination of social insurance participants.
On the State's policy on Social Insurance
The 2024 Social Insurance Law supplements regulations encouraging localities, depending on socio-economic conditions and budget balance capacity, to mobilize social resources to support additional social insurance contributions for voluntary social insurance participants and provide additional support for social pension beneficiaries (Clause 6, Article 6).
This content is also emphasized in the chapter on Social Pension Benefits (Article 22), which stipulates: "Depending on socio-economic conditions, the ability to balance the budget, and mobilize social resources, the Provincial People's Committee shall submit to the People's Council of the same level a decision on additional support for social pension beneficiaries".
Authority of the Chairman of the Provincial People's Committee in resolving complaints and denunciations about social insurance
The 2024 Social Insurance Law clearly stipulates the authority to resolve complaints and denunciations about social insurance for matters before January 1, 1995 (before the establishment of the Social Insurance agency), with the following contents:
Regarding the settlement of complaints about decisions and actions related to the enjoyment of social insurance regimes or the calculation of working time in the public sector to enjoy social insurance before January 1, 1995 without sufficient original records, no longer having original records or no longer having the agency or unit directly managing the employee, the following shall be implemented:
- The head of the provincial social insurance agency resolves complaints at the first instance.
- In case the complainant does not agree with the initial settlement of the complaint by the Head of the provincial Social Insurance Agency or the complaint is not settled within the prescribed time limit, he/she has the right to appeal to the Chairman of the provincial People's Committee or file a lawsuit in court according to the provisions of law.
- In case the complainant does not agree with the second complaint settlement of the Chairman of the Provincial People's Committee or the complaint is not settled within the prescribed time limit, he/she has the right to file a lawsuit at the Court in accordance with the provisions of law.
Regarding the settlement of denunciations on social insurance: The Chairman of the Provincial People's Committee is responsible for settling denunciations of violations of the law by agencies, organizations and individuals in complying with the provisions of the law on social insurance before 1995./.
